Implementeringen av miljöansvarsdirektivet i den svenska rätten : En europarättslig studie om förvaltningsförfarandet vid miljöskador utifrån principerna om god förvaltning och processuell autonomi

The aim of this thesis is to examine how the EU directive 2004/35/EC on environmental liability impacts the Swedish administrative legal order. The thesis examines the directive through two main EU principles - the principle of good administration and the principle of procedural Autonomy. The EU principle of good administration as a concept contains various procedural and substantive obligations that make up the subject for examination of the directive, both as regulated in the directive and as general principles of EU law. The directive is analyzed using a comparative method to determine to what extent the procedural and substantive principles of the directive impacts the Swedish administrative law, and weather or not the Swedish regulations comply with the EU principle of good administration.The results of the study shows that, althought there?s a general principle of national procedural Autonomy, the EU principles of good administration do affect the Swedish administrative regulation in various aspects, through the implementaion of the directive on environmental liability as well as general principles of EU law.

Arbetsmotivation och psykisk hälsa bland sjuksköterskor inom psykiatrin : En jämförande studie mellan yngre och äldre sjukksöterskor

Background: The relation between work motivation and well-being are relatively well theoretically entrenched, but few studies have been conducted on nurses within psychiatry. Objective: The aim of the present study was to examine the differences in intrinsic work motivation (Autonomy, competence, relatedness), mental health and burnout between young (?40 years) and older (>40 years) nurses employed in psychiatry. Method: The study was an observational study with a cross-sectional design and group comparisons, conducted as a survey. The sample constituted of 60 employed nurses.

Regional Styrningsproblematik i ett Utvidgat Europa - en komparativ fallstudie av Frankrike och Polen

The aim of this comparative study is to analyse the French and the Polish regional governance in order to see if there are any differences in their regional ruling systems. Further more I will study their different possibilities in taking part in the European Union regional political market. The shape of the regional systems will be explored both organisationally (study of the institutional entities of the regional construction) and functionally (study of the competencies of the regional body etcetera) to focus on its cause on the regional development. My over all focus will be to find out whether regional rule means differently in the countries France and Poland.Several questions are dealt with and the two main ones are as follows; How do the different structures of the form of government in France and Poland influence the governance on the regional level? Do Poland, as a new member state of the European Union, have what it takes to face the challenges of the new membership; or are there a complex of problems arising from the admittance that prevent its regions from fully taking part in the European regional political market?Some of my conclusions are as follows;There are major differences between the two countries when it comes to their regional ruling systems leading to different abilities in taking part in the European regional political market.

Barns lek och autonomi i förskolan : En filosofisk granskning av barnets och lekens etiska ställning i den svenska förskolan

This essay is a philosophical investigation of the relation between children and their play. My aim is to see if children are autonomous when it comes to their play. Is there a moral boundary between those who take part in the play and those who do not? This topic is especially important when it comes to the moral status of a child in the Swedish pre-school. How should educationists act when it comes to children?s play?  Through an analysis of the notions of play and Autonomy I show that play can be understood as something of a moral value to the child and if children should be seen as autonomous when it comes to their play.

Motivation i arbetslivet

Syftet med studien var att belysa hur motivation på arbetsplatsen kan betraktas från ett inre och yttre perspektiv, med utgångspunkt från ett antal specifika faktorer såsom samhörighet, kompetens, autonomi och kontroll i tillvaron. 126 respondenter, 99 kvinnor och 27 män besvarade en enkät som bestod av demografiska frågor, frågor kring chefens stöttande av autonomi, frågor om samhörighet, kompetens och arbetsmotivation samt ett testbatteri bestående av IMI scale, Work Extrinsic and Intrinsic Motivation Scale och Locus of Control. Studiens resultat visar att chefens stöttande av autonomi påverkade de anställdas inre arbetsmotivation positivt. Studien visar även på att det finns ett svagt samband mellan inre arbetsmotivation och tillfredsställelsen av de anställdas behov av autonomi och samhörighetAbstractThe purpose of this study was to see how work place motivation can be seen from an intrinsic and extrinsic perspective, with starting point from specific factors such as relatedness, competence, Autonomy and control. The 126 respondents of the study, 99 women and 27 men, answered a questionnaire that consisted of a few demographic questions, questions about if the boss is supportive of Autonomy, questions about relatedness, competence and work place motivation.

Arbetsmotivationens betydelse för engagemanget i en organisationsförändring

The purpose of this study was to examine the relation between self-determination theory and its three basic needs: competence, Autonomy and relatedness, and commitment to change in an organizational change. Another purpose was to examine if the quality of the communication and the effects on the organization and way to work can predict commitment to change. Considering that organizational changes is very common today there is an interest to ease and improve the change process. The survey contained the scales Commitment to change scale and Basic need satisfaction at work scale and the participants were 39 office-workers who recently had gone through an organizational change. The result indicated that it?s possible to predict commitment to change from self-determination theory, communication and effects on organization and way to work.

Development managers are characterized as grassroots bureaucrats, then they are officers who are in the organization, but also has a direct contact with the elderly applicants for municipal assistance. I wanted to explore how these policies relate to the older people's Autonomy and their implications for officer assistance in their daily work. As a theoretical starting point I have used out of a närbyråkratiskt perspective, and a negotiation perspective.

Autonomi och gemensamma strävanden

The liberal state, it has been argued, must be neutral between different conceptions of the good. Embodying ideals such as fairness and impartiality, state neutrality is intuitively appealing, but working as a restraint for state actions it is somewhat unsatisfactory. People make mistakes about their lives and people live less valuable lives than they could do. To then restrain the state from doing as much good as it can seems just as unappealing as neutrality at first seemed appealing. In this paper, a possible solution to this dilemma is presented.

"Ska jag släppa eller ska jag kontrollera?" : En kvalitativ studie om enhetschefers och omsorgspersonals förhållningssätt till sexualiteten hos människor med utvecklingsstörning.

The aim of this study was to, on the basis of normalization and Autonomy; investigate how staff working in group homes discusses about sexuality of people with an intellectual disability. Our study was based on ten semi-structured interviews of both care staff and heads of group homes to get responses from different levels within the same organization. The empirical material was analyzed through the theory of social constructivism, which focuses on how we construct the world through interaction and language, and the normalization principle whose goal is that all people with developmental disabilities should have the opportunity to live like all other people. We view these theories as useful to gain understanding of the questions in our study. The result of this study showed that the subject only comes up for discussion when problems arise, that the communication on the subject is inadequate and more discussion is requested.

Alternativet till ett misslyckande? Stadsdelsorganisationen i Malmö. Idag och imorgon.

From a democratic point of view the existing organisation with municipality sections in the city of Malmö, Sweden will be examined. The matter of how an alternative organisation should be structured will also be discussed. Two incompatible models of democracy theories will be arranged: libertarian democracy and participation democracy. The intentions with the reform were primary to increase the civic participation. By applying those values that are used to characterize participation democracy it will be shown whether the local participation has actually increased.

In this essay I will look at the independence of the Swedish municipalities. By looking at articles for the biggest journal in Sweden on this subject Kommun aktuellt I will look at the discussion for the years of 1978 and 1998 to see if one can draw some parallels in the debate and see if some subjects are always returning in the agenda for the independence. The Autonomy of the Swedish municipalities is a very important part of the Swedish welfare model. The municipalities handles for example both the primary schools and the social welfare services. Both these institutions are money draining and the municipals right by law to claim local tax does far from all the time cover its expenses.

8263 kilometer: En studie i avståndets påverkan på styrsystem

The aim of this Master?s thesis is to study the effects that geographical distance have on the control systems in a scattered organization and how this, ultimately, affects the employees in terms of loyalty and motivation. In order to do this, a case study has been conducted on a multinational travel group and its local branches in Thailand. The study is based on a selected number of theories focusing mainly on control systems in multinational contexts as well as on theories regarding communication and Autonomy. The conclusion of the study is that geographical distance has led to a rather large Autonomy for the local branches and that the headquarter to a large extent rely more on formal control.

Kan befattningen påverka inre arbetsmotivation och psykiskt välbefinnande? : En studie med tjänstemän med olika grad av individuella krav och kontroll på arbetet

The aim of this study was to examine differences in the experience of intrinsic work-motivation and to examine changes depending on profession, where the purchasers experienced a higher level of individual demands and control than the production leaders. Another purpose was to see how the intrinsic motivation needs predicted mental well-being in the professions. The study was carried out using an internet survey that was distributed by e-mail, there were 98 participants. Two questionnaires were used; Basic Need at Work scale (W-BNS) measured intrinsic motivation and GHQ12 measured mental well-being. The result showed that the staff overall had high intrinsic motivation with highest scores on relatedness followed by competence and lastly Autonomy.

Region Skåne - nätverk utan koppling

I have studied how human networks can affect decision-making and different constellations. The primary purpose is to clarify the possibility to affect the decision to move the infrastructure investments from Region Skåne to Region Västra Götaland. The study starts at the EU-level and continues to the Government and on to the region. Region Skåne is studied especially since it was from there the infrastructure investments were moved.The conclusion is that there is no specific representation in the government that represents regional topics, in spite of the fact that almost 30% of the members of the Parliament come from these regions. There is no discussion between the members that could be considered a networking-activity beneficial for the regions.

Riskerar allmänhetens tillit till den svenska sjukvården / till svensk läkarkår att lida allvarliga men vid en legalisering av aktiv dödshjälp i Sverige?

In this essay I have tried to come close to a probable answer to the following question: Is there a risk that the trust between the Swedish public and the Swedish medical services staff, including the doctors, will be severely damaged if euthanasia is legalized in Sweden.In order to try to answer that question, and some other relevant questions that has corresponding interest in the context that euthanasia marks, I have done like this: I have investigated experiences from the Netherlands and from Oregon. Since euthanasia is legalized - though partly in different forms - in both these sites. I have then tried to relate the most relevant parts of these experiences to a theoretical frame. This frame had been set up by three concepts: the sanctity of life, Autonomy and trust.I have also tried to come close to understanding the impact that demands for Autonomy has in this context. And I have tried to understand if the trust that the public has for a country´s medical services staff and the actual doctors is a form of trust that ought to be understood as a form of trust incorporated in social capital.I have come to the conclusion that there is no great risk that the trust between the Swedish public and the Swedish medical services staff, including the doctors, will be severely damaged if euthanasia is legalized in Sweden.
