Svensk asylpolitik En studie av väntetiderna och dess konsekvenser

During the 20 century millions of people have escaped from war, threat against their human rights, economic injustices and pursuit. The great numbers of fleeing people have lead to difficulties in Asylum investigation in the countries, which receive the Asylum seekers. Sweden is a country, which has ratified the Genéveconvention 1954, and receives the Asylum seekers. The great numbers of Asylum seekers have caused among other things long time of waiting for the Asylum seekers, sometimes up to 2-3 years. This implies some consequences both for the Asylum seeker and for the community.

The questions this essay answers are:1) Which are the basic premises for an ethical Asylum policy?2) Does the Swedish Asylum policy forfill these premises? The study analyses in general terms the Swedish Asylum policy. It analyses both the Asylum law and the work of the executive authority. The analyse also includes a brief look at two Asylum cases.

Tolkningen utav asylutredningsmetodik : Är asylhandläggares tolkning utav asylutredningar för sexuell läggning lika?

The purpose of this study was to analyze the level of the uniform way of interpretation from the Swedish Asylum officers at the Swedish Migration Board, of Asylum investigations for Asylum seekers who claim sexual orientation as reason of refuge. The interviews with the officers were analyzed in relation to the policy document with investigation- guidelines and methodology. The results of the study showed that there was a uniform way to conduct Asylum investigations and interpret the policy document, this despite that the document was found to be ambiguous in certain aspects. The uniform interpretation of the Asylum officers was explained by the knowledge and understanding that exists within institutional organizations. This because the Asylum officers at the Swedish Migration Board might have similar experience, knowledge and also the demands related to Asylum investigations. The uniform interpretation demonstrated a strong similar common understanding of investigative work within the agency. This suggests a certainty that the investigations are carried out in a similar way regardless of which Asylum officer within the institution conducting the investigation which indicates a well-functioning ?rule of law? for the Asylum seekers. .

Diskursen kring asylsökande : En diskursanalys av Helsingborgs Dagblads och Dagens Nyheters konstruktion av asylsökande

The aim of this study was to examine the discourse of Asylum seekers in Sweden from January 2009 to December 2013 in the newspapers Helsingborgs Dagblad and Dagens Nyheter. By using discourse analysis as a theory and method, combined with the theory of orientalism, I have analysed and compared news articles from these two newspapers. The findings of the study shows that Asylum seekers are often portrayed as a group rather than individuals. Included in the group identity are several subgroups, for example Asylum seekers are portrayed as victims, as a cost to society and as a highly suspect group that cannot be controlled. Furthermore, Asylum seekers are depicted as ?the other? in contrast to the Swedish ?we?, where differences in culture and tradition are frequently mentioned.

This study analyse these experiences from a social psychological perspective, from this analysis we aimed to obtain a deeper understanding of how the experiences from the country of origin affects on the experiences in the Asylum process. This study shows that LGBT Asylum-seekers often is facing negative reactions from the environment in the country of origin, these reactions can limit their possibilities to express their sexual identity or gender identity in the Asylum process in Sweden. The negative reactions they experience in the country of origin have contributed to that many LGBT people internalize feelings of fear to express themselves, feelings that often stays when they come to Sweden to seek Asylum.

En påstådd sexualitet - En diskursanalytisk undersökning av svenska migrationsmyndigheters syn på sexualitet i relation till hbtq-personers asylärenden

The purpose of the essay is to examine the views on sexuality that guide the Swedish Migration board and court?s judgments and decisions in Asylum cases. The essay investigates seven cases from the Swedish Migration court regarding Asylum seekers from seven different countries seeking protection in Sweden due to their sexuality and/or gender identity. By applying discourse analysis, along with the theoretical perspectives of Judith Butler and the postcolonial critique of Chandra Talpade Mohanty, the essay discuss what kind of criteria and/or practice is demanded of the Asylum seekers to be rendered as trustworthy. The essay concludes that the Asylum seekers are considered untrustworthy by the migration authorities when not acting according to a (hetero)normative sexuality.

En studie av framväxten av en europeisk asyl-och migrationspolitik

This thesis treats the development of the European Union Asylum- and migration politics and the EU member states transfer of authority to the European Union. The main purpose has been to look closer with the use of the application of theory of neofunctionalism and liberal intergovernmentalism on the European Union case. The focus will be to answer the following questions: How has the political development within EU Asylum and migration policy developed through the period of The Single European Act to the ratification of the Stockholm program? And how can the chosen theory explain European countries transfer of national decision regarding Asylum policy in favor of a supranational European Asylum policy? Based on the available material of European Union programs and harmonization measures for this area I have attempted to understand to what extent the European Union?s development in the area of the Asylum and migration politics can be explained through the theories of neofunctionalism and liberal intergovernmentalism. The result of my analysis is confirmation of the European Union development of the area of the Asylum and migration policy and also a series of explanations according to the theories regarding the member states transfer of authority to the EU.

I samhällets väntrum : Om asylsökande och den långa väntan på att få komma in

The purpose of this case study is to demonstrate how societal mechanisms can impact on Asylum seekers and influence their individual identity. The information for this case study was collected through comprehensive interviews with a group of Asylum seekers from Söderhamn whereby the individuals expressed their perception of their current situation. From the gathered material we could see a pattern emerge which gave us the framework and the foundation for our theoretical approach. The similarity we discovered when analyzing the material was the powerlessness the individuals experienced e.g. the individuals had no possibility to influence their current situation and worse, it was impossible for the individuals to enter society even when they had the willpower to do so.

EU, den fria rörligheten och asyl - En studie av EU:s viseringsregler och Dublinförordningen

This thesis studies two instruments within EC-law, affecting Asylum issues, the Schengen Convention and the Dublin Regulation. These instruments are developed as a result of the free movement of persons in the European Union, and the development of the free internal market. The member states are afraid of losing control of who is residing within their borders, as their border controls has been removed, and these instruments are made to protect the member states now that their own means of control are gone. The thesis explains the relationship between the free movement and Asylum issues and shows the connection between them. Its focus is aimed at the free movement of workers and how the European court of justice has interpreted article 39 to increase the workers ability to move within the union.
