Upphovsrätt i förändring? En undersökning av några upphovsrättsorganisationers remissvar på Ds 2003

In the year 2003 the Swedish ministry of Justice drew up a communication about the incorporation of the European Unions directive about harmonisation of certain aspects of copyright and related rights in the Information Society, 2001/29/EG. The communications name is Ds 2003:35. This study examines the arguments in the communications from some of the copyright organisations in Sweden. For this study we have used five referral statements from organisations who represents different types of originators. We have studied their arguments and how well they argue for their theses. The copyright organisations argue for stricter copyright laws and the purpose of this study is to examine why they recommend this. We have looked into the parts of the communication that will have an impact on the situation of the public libraries. The study contains a review of the treaties and conventions that lead up to the drawing up of the proposal. We also present a review of the Swedish copyright laws, the history, the changes and what its purpose is. We also introduce the communication Ds 2003:35 with particular emphasis on the articles that we examine in our analyses. We present how the articles are designed today and what the proposed changes are. We found that the organisations arguments are almost exclusively of economic character. The organisations ask for stricter copyright laws in order to make higher profit. The originators non-profit rights are not being considered at all in the communications.
