En analys av socialsekreterares och förvaltningsrättens bedömning genom rättsfall av hedersrelaterade LVU-ärenden


One of the social services primary missions is to protect children from suffering harm. Social service work should work based on the child?s best and have the child's perspective in mind. In all cases involving children, the focus is on the child's needs and interests and is regulated in Convention on the Rights of the Child (CRC). Both of the previous research and this study reveal the various markers that are evident in the social services handling of honor related cases. Previous research has shown that the evidence of ill-treatment in honor related cases is higher for a LVU disposal than other LVU disposal. The aim of the study was to examine the basis on which decisions are made, whether there is a discrepancy or consistency between the social and judicial assessment of honor related cases. The paper also examines how honor problems are constructed in and through social services and the administrative law judgments. To study this phenomenon, the study was based on a document analysis of nine cases from administrative law. In the analysis it appeared that the administrative law does not use the concept of honor in their decisions while the social services and other agencies usually assume that the problem is honor related. Thereby the social services and other authorities are contributes to construct and reconstruct honor related problems as a social problem. Another result that was found in the study is that the administrative law are listening to the child?s voice and considering a child's perspective in their decisions which is different from previous research results.
