En studie om regleringen av klädkoder på arbetsplatsen


In today?s society, employees are the businesses face toward the public. By establishing dress codes, companies can control the customers? impression. The purpose of this thesis is to investigate and analyze the existing regulations regarding dress codes in companies. By doing this, this thesis will clarify the existing legal regulations regarding dress codes, employers? possible demands towards their employees' appearance during work, possible sanctions from the employer and to investigate how far an employer can control the employees? appearance in cases were the dress code interferes with religious views.Few regulations exist and unfortunately there is a lack of case law regarding dress codes. Protective clothing is regulated by law. Clothing required for reasons of health is governed by regulations issued by authorized authorities. Dress codes can be established by either agreements or unilateral employer regulations under the employers right to manage and distribute work in the work place. This within the limita­tion of generally accepted principles, meaning the management cannot be practiced in an arbitrary or unduly manner. Refusal to follow the dress code may be grounds for sanctions against the employee and may result in termination in case of continued negligence.The requirements for clothing during work must be proportional to the purpose. This means that when a conflict of interest arises, an assessment between the employer?s interest to keep the dress code and the employee?s reasons for refusing it shall be done. Employers need the dress code issued to account for religious views. A need to protect the people from illness, should necessitate the dress code to be orientated toward practical and hygienic reasons, rather than being orientated toward religious beliefs contrary to medical considerations.
