Förstainstansrättens dom i målet Microsoft mot Kommissionen har gett upphov tillmånga konkurrensrättsliga frågor, bl.a. gällande Microsofts Tying av WindowsMedia Player till sitt operativsystem Windows. Denna uppsats för framförallt ettresonemang kring frågan om huruvida de ?traditionella? EG-rättsliga metodersom idag används vid bedömningen av kopplingsförbehåll (Tying) är förlegade närdessa ska appliceras på en ?ny? produkt som mjukvara. En analys av konkurrensrättsligdoktrin och rättspraxis visar att Microsoftdomen i delen vad gäller Tying ärkonsekvent gentemot den praxis som etablerats på området genom målen T-30/89Hilti AG mot Kommissionen samt C-333/94 P Tetra Pak International SA motKommissionen.

The purpose of this thesis has been to gather knowledge about the complaints of Tying-up in horses and to show that the importance of feeding. The thesis includes a literature review of Tying-up how preventative measures by feeding can be made. In the equine sport, crosscountry, horses occasionally suffers from Tying-up, a muscle disease. An increased knowledge about the disease is demanded by riders and trainers as the disease disrupts training and competition of suffered horses. A cross-country horse works very hard in training and during competitions but the work bouts are long enough for the muscle cells to use aerobic pathways in the metabolism.

The competition policy in the EU should guarantee that the competition is not distorted in the way that would prevent or create difficulties for the free mobility of goods and services between Member states. It is prohibited for companies to abuse their dominant position according to Article 82, if it affects trade. The essence of Article 82 is control of market power. The perfect competition results when supply and demand appoint the price and quantity of a product. Firms are encouraged to compete then it results in efficiency, quality products and lower prices.

The purpose of this thesis is to study to what extent the methodological theories are being reflected in the construction of user surveys at public libraries in Sweden. The study has been conducted as a qualitative literature study in two parts. The first part is an examination of literature concerning survey methodology; the second part is a study of three user surveys conducted at Swedish public libraries after 1995. Our main results indicate that the theories about methodology are followed in part, though it cannot be determined whether this is due to any actual methodological studies, common sense, or just copying other surveys. In our study we have found some areas of user survey construction that need further attention and that would benefit from more extensive methodology studies on the part of survey designers.

The aim of this study is to investigate which management control mechanisms evolve in companies that receive funding from Venture Capital companies and why the management control systems evolve in the way that they do. A case study was performed on three Swedish high technology companies, that all received funding from Venture Capital companies for the first time in 2006. Merchant?s framework, defining all management control mechanisms as either, results control, action control or personnel control, was used to structure the study. Results show that the companies that received Venture Capital all increased the use of management control mechanisms within results control, action control and personnel control.

Microsoftdomen grundar sig i att Microsoft vägrat lämna ut interoperabilitetsinformation till en av sina konkurrenter (Sun). Sun menar att detta konstituerar ett missbruk av dominerande ställning och lämnar in ett klagomål till Kommissionen som påbörjar en utredning. Kommissionen börjar dessutom på egen hand utreda huruvida Microsofts integration av Windows Media Player i sitt operativsystem (Windows) kan utgöra ett missbruk. Den 17 september 2007 blev Microsoft dömda av Förstainstansrätten för missbruk av dominerande ställning. Detta ledde till ett par påföljder för Microsofts del.
