Syftet med denna uppsatts är att utreda hur befintliga servitut påverkas vid fastighetsbildning? vad som gäller enligt svenskt regelverk och hur det tillämpas praktiskt. Fastighetsbildning innebär förändring av fastigheter, genom antingen nybildning eller ombildning. Ett servitut är en begränsad rättighet som är belägen på en fastighet, som belastas av rättigheten, och som får nyttjas av en annan fastighet, som har förmån av rättigheten. I samband med fastighetsbildning kan befintliga servitut komma att påverkas på olika sätt.De metoder som använts är: (1) en litteraturgranskning där den svenska lagstiftningen studeras; (2) en fallstudie där utförda förrättningar studerats om huruvida befintliga servitut påverkats vid fastighetsbildning och (3) en intervjustudie med yrkesverksamma förrättningslantmätare som arbetar på Lantmäteriet.Undersökt litteratur visar att Jordabalken och Fastighetsbildningslagen reglerar hur befintliga servitut påverkas vid fastighetsbildning.

En aktiv databas reagerar automatiskt på händelser som genereras internt eller externt i databasen. Det aktiva beteendet i ett databassystem kan ses som övervaknings-funktioner för databasen. Det innebär att kritiska system som stridsledning, sjukvård och kärnkraftverk har stor förtjänst i att använda aktiva databaser. En passiv databas, vilket är det vanligaste idag använder sig av polling och embedded code för att åstadkomma aktiviteter som finns i den aktiva databasen. Dessa lösningar genererar dock redundans, överbelastning av systemet och tidvis inkorrekt information.Vid ett systemutvecklingsarbete används oftast en eller ett antal bestämda metoder som tillför riktlinjer och tekniker till utförandet av arbetet.

Bakgrund: På senare år sparar nästan alla svenskar mer aktivt och den positiva utvecklingen på aktier har gjort att allt fler aktiesparare lockats in i aktiemarknaden. Detta har bidragit till att aktier blivit den främsta tillgången för sparare. Ägandet av aktier är förknippat med har medfört flertalet risker då det finns en risk att aktiekurserna kan falla. Flertalet investerare har en diffus uppfattning om vilka risker som tas. Identifierar aktiespararen riskerna med aktiesparandet så förbättras förutsättningarna för en bra avkastning.

Cellulose nanocrystals (CNC) are great candidates for composite materials. The reasons why CNCs are such attractive materials for them are due to their great mechanical properties, high aspect ratio and low density. On the other hand, hydroxyapatite (HAp) is a kind of calcium phosphate and a main component of bones and teeth. The purpose of the present study is to make oriented nano-sized composites with CNC and HAp. Although some researchers carried out to make CNC composites with HAp for biomedical materials, nano-sized and oriented ones haven?t been achieved yet.

The aim of this essay was to describe the power elite of the Swedish town Karlshamn, and its influences on the local political process before the realization of the narrow-gauge railway Karlshamn-Wislanda-Jernväg. During the mid 19th century, a revolutionary period began in the Swedish pre-industrial epoch. The political and institutional regulatory frameworks were disassembled and restructured, away from protectionism and centrally controlled administration, for the benefit of free trade, local self-government and liberalism. The changes were carried through during times marked by a drastic increasing native population and upcoming demands for adjustments to meet the growth of the industrial-, trade- and labour markets. An essential industrial development factor was the building of the national railway network, which started after some important decisions in the Swedish Riksdag during the 1850´s.

During the past 10 years Sweden has updated its penal code for sexual crimes twice. Despite this few are convicted for the crime of rape in Sweden. As the majority of perpetrators being male, this is a problem concerning women?s rights to respect for their bodies and personal integrity. A possible explanation, and this study?s point of departure is a potential discrepancy between the intention of the law and the interpretation of the same as the Swedish legal system rests on a foundation of legal positivism.

Frigoscandia Freezer AB have seen themselves as an entrepreneur company for a long time, but have lately begun to realise that they have to go against a more administrative era. With that insight they have begun to examine their enterprise in order to achieve this. The division Team Spare Parts has started a project with the intention of checking-up the inventory management, and improving it for the future. To get support for this and other point of views, they decided to let us do our exam thesis as a part of the project.The first part of the thesis deals with the appropriate inventory theory. Presumtionsreglerna i 11 kap. ÄB får anses vara ett hjälpmedel vid tolkning av testamenten som i sig inte ger tillräcklig ledning för vad testatorn avsett ska hända med sin kvarlåtenskap. Dessa presumtionsregler är tänkta att ge uttryck för vad testatorer i allmänhet vill ska hända med sitt arv efter sin bortgång i specifika situationer. Att reglerna ska ge uttryck för vad den ?genomsnittlige? testatorn vill innebär att reglernas utformning måste vara av generell karaktär.

I samband med fastighetsaffärer har ansvaret mellan parterna delats upp så att köparen ansvarar för faktiska fel medan säljaren svarar för andra typer av fel. Köparen har dessutom en långtgående undersökningsplikt för fel som denne inte har möjlighet att senare påkalla mot säljaren. Säljaren har å sin sida en upplysningsplikt som dock inte är generell utan omfattar endast vissa fall. I samband med domen i NJA 2007 s 86 kom frågan om felets väsentliga betydelse för köparen och själva köpet som sådant upp. Tyvärr gjorde HD ingen utförligare utredning av vad som skulle bedömas eller omfattas av begreppet.Till följd av att rättpraxis saknar en utförlig förklaring kring vad som ska omfattas av begreppet väsentlig betydelse trots att det vid flera tillfällen använts i både rättspraxis och doktrinen har detta utgjort grunden för den här uppsatsen.
