Offentlig upphandling och Kundval : Hur skall kundvalsmodellen tillämpas i förhållande till lagen om offentlig upphandling?

Det generella syftet med detta examensarbete är att utreda om kommuner och landsting kan frångå upphandlingsregleringen vid tillsättningar av kundvalsföreträdande tjänster, vilken påverkan kundvalssystem har på mindre oetablerade företag samt hur detta påverkar det traditionella upphandlingssystemet. I samband med att två nya EG-direktiv på upphandlingsområdet inte implementerats i svensk rätt inom den angivna tidsfristen, belyses frågan ur både ett de lege lata- och de lege ferendaperspektiv.Uppsatsen uppdelas i tre sammankopplade avsnitt där det första utgör bakgrund för studien. I det andra kapitlet påvisas gällande rätt utifrån ett deskriptivt förhållningssätt för att i det tredje penetrera kundvalssystemet utifrån ett mer praktiskt, analyserande, perspektiv. Denna sammanställning har utmynnat i följande slutsatser.Kundvalssystem har sedan starten i början på 1990-talet utvecklats till att bli ett användbart alternativ till traditionella upphandlingsförfaranden och till stor del har frågan om laglig tillämplighet förbisetts. För att upprätthålla ett rättssäkert förfarande bör sannolikt officiella procedurregler skapas för att undvika en splittrad kvalitet och en olikartad bedömning mellan de olika kommunerna och landstingen i Sverige.Ett ökat entreprenörskap kan resultera i högre kvalitet och ökad effektivitet, som i förlängningen genererar lägre kostnader.

Snabblån : De lege lata och de lege ferenda

Utveckling på kreditmarknaden har gett upphov till nya kreditformer. Ett exempel på en sådan kredit är snabblån. Snabblån utmärks av att det är kortfristiga lån på låga belopp som konsumenterna erhåller inom en kort tidsperiod. Vidare är låneprocessen enkel. Statistik från Kronofogdemyndigheten visar att antalet betalningsförelägganden med grund i snabblån har ökat (se bilaga) och regeringen hävdar på basis av statistiken att samband mellan snabblån och överskuldsättning föreligger.

Declining union memberships are a fact in both Sweden and Finland. At the same time, the autonomous labour market parties and the high membership rates are the most significant factors for the two countries compared to Europe and the rest of the world. These two factors have in turn been developed and strengthened since the beginning of the twentieth century. By autonomous labour market parties I refer to the fact that the labour market parties themselves through collective bargaining are agreeing on the labour market conditions, without interference from the government.This paper is therefore taking it's stance in the question of what happens with the autonomous labour market parties when the membership rates are in decline. With this in mind, this paper describes the judicial development, the collective agreement and labour market structures, the legal consequences of collective agreements and the opportunities of industrial and sympathy action in both Sweden and Finland. The two countries' systems of labour law have caught some negative attention, hence two of the most discussed cases of recent years are given some attention as well. The collective judicial conditions are very similar in both Sweden and Finland regarding the labour market main actors' collaboration, the collective agreement structures and legal consequences and the opportunities of industrial and sympathy action.

Fattar företagsägare ett ekonomiskt rationellt beslut med att slopa revisorn? : En kvantitativ studie

Revisionsplikten i Sverige avskaffades för några år sedan för de minsta aktiebolagen och idag är det ett omdiskuterat ämne. Det är dock först nu som effekterna börjar visa sig. Idag är det cirka 80 procent av de minsta bolagen som inte anlitar en revisor. Studien har utförts ur företagens perspektiv och syftet med vår studie har varit att undersöka om bolag som inte anlitar en revisor har fattat ett ekonomiskt rationellt beslut. För att genomföra studien har vi använt oss av kvantitativ metod med deduktiv ansats som utgått från positivistisk kunskapssyn. Vi har bland annat undersökt om ett antal nyckeltal skiljer sig mellan reviderade och oreviderade bolag.

Kalkyl för logistikkostnader; från leverantör till förbrukningsplats

The globalization that has occurred during the last few years has made it more important for companies to have a well-functioning logistics system. Customers demand more options, which lead to an increased flow that creates greater demand regarding packaging and transports. Diverse logistics costs are nowadays a substantial cost for many companies. Therefore, more effort is aimed at optimizing transportation to lower these costs.The purpose of this project is to create a user-friendly calculation of logistics costs that illustrates how the costs vary, depending on how the flow is structured. This is done by examining which aspects that affect the total logistics costs and by mapping which aspects that should be included in a calculation of the logistics costs.Literature studies have been carried out parallel with empirical studies at Scania's production unit, MC, in Oskarshamn.

Hence it is of key concern for business leaders to appreciate how operations best are run to maximize value creation. This study explores how financial theory can reveal the link between one particular business strategy and the corresponding effect on shareholder wealth. The question in focus is whether construction companies can enhance their value creation by implementing shift-work to increase the weekly production rate. The thesis particularly targets apartment block projects in Sweden and has the construction company Peab AB as primary object of study.

 AbstractMedia has since a long time back been writing about extensive thievery of recreational boats and their engines. The value of the stolen goods is estimated to several hundreds of million Swedish crowns per year. The widespread stealing creates a secondary market where boats sometimes are sold by sellers that do not have the rights to sell the boat. This creates risk for the buyer who most often is a private person. A situation the buyer can face is that the boat was stolen and that the original owner can demand to get the boat or engine back.

Skogsbränslekedjan och behov av avtalsmallar för skogsbränsleentreprenad

Användningen av bränslen med skogligt ursprung har i Sverige ökat stadigt sedan 1980-talet. Tänkbara anledningar till ökningen är en ökad medvetenhet kring enregisystemens miljö- och klimatpåverkan samt att energipriserna stigit och gjort det lönsammare att ta ut bränslesortiment från skogen. De främsta förbrukarna av dessa bränslen är idag den svenska industrisektorn och kraft- och värmeverk. Syftet med denna studie är att kartlägga hur uttaget av skogliga bränslesortiment går till idag och hur avtalsförhållandena för de till uttaget och vidareförädlingen kopplade tjänsterna ser ut.

The purpose of this work has been to investigate if there are any differences in the valuation process at infringements when highway and railway are built. The work has mainly been concentrated on the negotiation process in which The National Railway Department (Banverket) and The National Road Administration (Vägverket) try to get agreements with the land owners. The agreement includes compensation for infringement effects that affects the landowner?s property. The National Road Department uses the road law (Väglagen) when a highway shall be built.
