Förstainstansrättens dom i målet Microsoft mot Kommissionen har gett upphov tillmånga konkurrensrättsliga frågor, bl.a. gällande Microsofts tying av WindowsMedia Player till sitt operativsystem Windows. Denna uppsats för framförallt ettresonemang kring frågan om huruvida de ?traditionella? EG-rättsliga metodersom idag används vid bedömningen av kopplingsförbehåll (tying) är förlegade närdessa ska appliceras på en ?ny? produkt som mjukvara. En analys av konkurrensrättsligdoktrin och rättspraxis visar att Microsoftdomen i delen vad gäller tying ärkonsekvent gentemot den praxis som etablerats på området genom målen T-30/89Hilti AG mot Kommissionen samt C-333/94 P Tetra Pak International SA motKommissionen.

När vi studerar så bedömer vi kontinuerligt vår egen inlärning via en så kallad inlärningsbedömning Judgement of Learning (JOL), vilket ligger till grund för vår reglering av till exempel studietid. Denna studie undersökte om de bedömningar vi utför även påverkar vårt minne. Tjugoåtta deltagare delades in i två grupper som fick lära sig 40 ordpar på samma sätt, följt av ett minnestest efter ett retentionsintervall på fem minuter. Den enda skillnaden mellan de två grupperna var att ena gruppen bedömde sin inlärning tre gånger och den andre endast en gång. Resultatet som erhölls visade att det inte var någon signifikant skillnad mellan grupperna, det vill säga att den grupp som utförde tre bedömningar inte mindes materialet bättre än den grupp som enbart utförde en bedömning.

Syftet med denna studie var att studera möjligheten att bedöma korrekthet i vittnens utsagor beroende av deltagarnas grupptillhörighet. I studien ingick 120 deltagare som antingen fick se en film med vittnesmål från fyra vittnen med enstaka centrala meningar eller läsa en text med samma meningar. De viktigaste mätningarna i denna studie gjordes efter signal detection theory (SDT). Resultaten visade att deltagarna inte skattade mycket över slumpnivå och ofta till och med under slumpnivå i sina bedömningar. I en hopslagning av betingelserna (text/film) visade analyserna att män generellt var signifikant sämre än kvinnorna på att bedöma vittnesmål, men att kvinnorna gör fler falska alarm än männen i bedömningen av textversionen.  De funna könsskillnaderna i hur vittnesmål bedöms diskuterades..

Syfte: Studiens syfte är att beskriva och analysera erfarna revisorers uppfattning om ettstrukturellt arbetssätt i form av checklistor för både erfarna och mindre erfarna revisorer.Empirisk metod: Studien bygger på en kvantitativ metod i form av en enkätstudie utskickadtill alla Sveriges auktoriserade revisorer. Svarsfrekvens var 4,8 procent. Svaren analyseradesgenom Pearson korrelationsmatris, multipel linjär regression och t-test.Resultat: Resultatet visar en generell positivitet till checklistanvändande, dock är revisorersuppfattning att de är mer positiva till att de mindre erfarna revisorerna använder sig avchecklistor.Teoretiskt perspektiv: Applicerar teori om professioner, struktur och omdöme på revisorermed olika erfarenhet..

Violence against women is an extensive social problem that concerns us all. The women who seek health- and medical services when they have been exposed to violence and abuse have the right to expect being well taken care of and treated by competent and understanding personnel. A kind reception can make the patient feel comfortable enough to talk about their situation. The aim of this literature review was to determine how you as a nurse should treat a woman who has been exposed to battery, to be able to offer a professional and individual care. The frame of reference is Gustafsson´s SAUK-model since the acknowledged care aim to maintain and strengthen the human´s self-Judgement and self-determination.

With this paper my aim has been to investigate my subjectivity and responsibility as a landscape architect and to find ways to relate to it and handle it in my work. When I advocate a certain concept for a project, I influence the outcome, and in doing so I take on a personal responsibility. Even though my Judgement is built upon facts and cooperation with colleagues and other consultants, I am always responsible for the part I play and how I affect the course of action. To what extent can I advocate my view and is it actually my responsibility to do it? How is my subjectivity part of my knowledge and influence as a landscape architect? I have interviewed three well known Swedish landscape architects to have their view on the matter. Since they are all strong individuals with huge experience and influence, the personal responsibility they bring upon themselves for their design action is as important. I have also used one of my own projects as a case study, analysing my design and standpoint and my relationship to the client to illustrate how these questions emerge even in the smallest projects. In the last section of the investigation I have searched for clues in diverse literature. This section is divided into three view points; the society, the profession and the individual..

Do teachers? expectations of their pupils become a part in the Judgement of which grade a pupil will receive in the end?Several of the polical parties in Sweden have recently been argueing that teachers should be able to give pupils a grade in how they behave in school. Several newspapers also have reported that pupils today have gotten lower results for the last few years and more pupils do not get approved in all subjects. Because many of the studies about pupils results focus on the pupils? skills, I deciced to focus on the teachers part in how a pupil get a better grade or not.In the study I have been looking at a small community in the south of Sweden.

Aggression is a normal part of a dog?s behaviour repertoire and has always been an evolutionary relevant behaviour. Even if aggression in some contexts is relevant, it is one of the most common problem behaviour reported by dog owners. It has been discussed if some breeds are more likely to show aggression and therefore should be banned. On the 1st of January 2008 a new act was enforced by the Swedish government giving the police force greater authority in decisions to apprehend and euthanize dogs if they after an appropriate evaluation of the dog?s temperament think it is necessary.

This master thesis is an attempt to study the interface in itself, where the human meets the machine and the problems that can arise. I study a particular interface, namely the OPAC of Libra III. In 1999 IFLA presented recommendations for what an OPAC shall contain, and in one part of my master thesis I compare Libra III with these recommendations from my opinion. In another part of my master thesis I make an investigation where I let five by me chosen persons answer some questions from me, both by doing and verbally. I draw the conclusion that Libra III follows most of the recommendations of IFLA in a sufficient way.

The purpose of this study was to look into how evidence evaluation in verdicts considering 2 § LVU (Care of Young Persons Act) linked to honor related problems are handled by the County Administrative Court of Stockholm. The questions at issue were how the County Administrative Court handles the prerequisites regarding 2 § LVU verdicts, how the County Administrative Court proceeds when evaluating evidence in 2 § LVU verdicts, and how the County Administrative Court handles indications of that a child is living in an honor-related context. To answer this, five verdicts have been analyzed. In addition to this, two interviews were made as a complement. In the analysis of the collected material, the authors proceeded from a theory of evidence and used a hermeneutic method for the analysis.

Today all private corporations are obligated by statutory audit. The government of Sweden appointed an investigation to conclude if the audit should be statutory or not. The investigator presented on the third of April 2008 a report (SOU 2008:32) that suggests abolishment of the statutory audit for approximately 97 % of all private corporations in Sweden. This will result in certain effects on the banks credit rating because of the fact that the banks trust the audited accounts to have been audited by an independent audit.The most important in the banks credit rating are: personal Judgement, business concept, business plan and repayment ability. The banks also use the private corporations audited accounts in its credit rating.We conducted a case study by interviewing four bank officials in different banks in Skövde and Tibro.

The purpose of this masters thesis is to evaluate the retrieval effectiveness of three different search engines on the Internet: Google, Yahoo! and MSN Search. We have constructed 25 topics and queries with varying contents, in order to test the width of the search engines as much as possible. In every search we have evaluated the first 20 hits in each of the search engines. The measures we have used are precision and cumulated gain. Precision is based on a binary scale and cumulated gain is calculated by means of a non-binary relevance scale.

Six different Digital Proofing Systems from three different techniques have been evaluated as totechnique, printing quality, economy and usability. Digital proof from two paper qualities, coatedand uncoated, has been compared with references printed in offset, to see how good they match eachother. Only two Proofing Systems manage to print on reference paper. The other Proofing Systemsuse special paper for digital proof.Measurements and visuell Judgement show that the Digital Proofing Systems visualise referencepictures with quite good quality. Proof optimised for coated paper visualise the colours with goodresult.

Today the school is a given place for preventing social problems. The school struggles continuously to live up to the expectations of balancing preventive social work with pedagogy in a satisfactory way.The purpose of this essay is to get a picture of priorities of social work in school. I want to know what it is that affects and controls the principal's decision about what kind of social project they will accept and be a part of.This essay shows that only one of the eleven principals interviewed apply projects based on evidence when they decide about participation in a social project. Instead, the decisions are based on references from other schools. The reason why the principals do not base their Judgement on projects which are based on evidence is because they consider the search for results too time consuming.When there is no requirement that a certain part of the social work in a school must be based on evidence, it leads to the children taking part in different social projects which we can not guarantee are good for them.One solution can be to guide the principals through a national social teachingplan, which can assure that social work based on evidence are being applied in the municipality schools as well as the independent schools..

The aim of this paper is to see how the local authorities in Norrköping create a way to look at homelessness. This aim is examined with the help of the central questions: How does the municipality describe homelessness as a phenomenon? What causes to homelessness can be seen in the texts? How do they describe homeless people? And What kind of actions are used or proposed? The analysis has been done with the tools and thoughts of the critical discourse analysis and made on text documents written by politics and employees of the city of Norrköping. The theories which have been used are those of postmodernism, welfare, homelessness, civil society and relative poverty. The analysis shows that the way the municipality of Norrköping looks at homelessness correspond with the way homelessness is presented in current Swedish research.
