In 2006 there was a change in LMA (1994:37) that clarified the division of responsibility be-tween the Migration Board and the municipalities, concerning unaccompanied children. The social services should now be utmost responsible for the housing and care of these children, to assure that they gain the same standards and rights as all other children. The aim of this essay has been to examine how the division of responsibility has influenced the work of the social services and how they interpret their responsibility for the unaccompanied children. How do the social services investigate and make decisions concerning these children? Do these chil-dren have the same rights as other children? To answer these questions a legal study was made, followed by qualitative research interviews with four social services that receive unac-companied children.

Verksamhetsförändring : Sociologiska perspektiv på implementeringen av barnkonventionen inom BVC

This study aims to create an understanding of how employees relate to directives that come from a level above them in the hierarchy and is to be implemented in their working activities. This is studied by examining a case where a work group has tried to implement orders, given to them by the government and through a work group in the level above them in the organizations, concerning how employees working with child health care is to educate parents regarding the child convention. The method that have been use in this study is group interviews with 19 child health care nurses and the two main questions that are asked is why has it been difficult to implement the orders and how have the child health care nurses expressed their resistance to the changes, this since only five of the nurses had begun working with the child convention. The theories that have been used focus on how resistance towards change is expressed, organizational incapability and reluctance towards change, as well as how grass root bureaucrats relates to change. The conclusion that can be drawn from this study is that it is important to let the concerned parties participate from the beginning of the process, to minimize their reluctance to the changing process.

Rättssäkerhet i barnavårdsutredningar : BBIC - ett nytt sätt att arbeta i socialtjänsten

AbstractThe Swedish National Board of Health and Welfare has since a year or so started to introduce a new way to work with childcare investigations within the social services. This new concept, BBIC, is meant to put the child?s needs in the first room rather than the grownup?s as it used to be before. This study is about to examine how BBIC affects the legal security of the children within these childcare investigations.BBIC was first developed in England after a massive criticism against the way that the foster home- and institutional care was handled. In Sweden, BBIC was first tested and developed into Swedish conditions in a few project municipalities for about five years but is now being introduced all over the country.

Kvinnokonventionen- självklar men frånvarande. : En kvalitativ studie om implementering av Kvinnokonventionen

The purpose of this study is to examine the implementation of the Convention on the elimination of all forms of discrimination against women, CEDAW, in Uppsala local council and county council. The aim is to examine how the respondents, in their daily work, understand and implement the convention as well as how they consider the prerequisites for a successful implementation. The study was conducted using qualitative interviews with three civil servants and four politicians. The theoretical approach was implementation theory whose concepts willingness, comprehension and capability were used as tools for the analysis. The results portray CEDAW as a well-known treaty amongst the respondents but at the same time absent in local politics and everyday work.

United States is one of the two countries in the world that have not ratified the Convention on the rights of the child, and one of the few countries that sentences children less than 18 years to life in prison without parole. Besides this, corporal punishment is legal in all the states of USA. This essay is aimed at researching how these three factors affect one another in the American context and what consequences may come out of it. By the use of reports from NGO's and UN treaties together with various theories about the subject in question, I have looked into the juridical climate for today's young Americans.The conclusion of the essay shows that there is a tendency in the United States to control violence with violence, from a local level and further to a state level. As long as this attitude proceeds, the situation for children at risk for being sentenced to life sentence will not improve..

Unaccompanied minors who are fleeing and being sent way from their countries of origin are nothing new. In 2011, 12 225 unaccompanied minors where registered in The European Union, none undocumented minors included. Most of the minors are coming from Afghanistan and Somalia. The aim of this essay is to investigate how The European Union?s migration policies are applied in reality and how United Nation?s Convention on the Right of Children are put in practice by the member states of The European Union and Norway.

Girls in honour cultures have been the subject of many studies and are often debated in the media. The purpose with this study was to focus on boys in honour cultures. I wanted to understand the situation of boys in honour cultures with a perspective of the rights of children. My central questions were: How is it to be a boy in honour cultures? Are boys in honour cultures exposed? How are they exposed? My study was a qualitative study in which I interviewed four professionals who meet boys in honour cultures in their work.

En ny diskussion kring religionsfriheten : Alternativ till religionsfrihetsbegreppet under Europakonventionen och Europeiska domstolen för de mänskliga rättigheterna

Freedom of religion or belief is indisputable in Human rights discourse, more discussed is exactly what it is that is included in the concept of freedom of religion or belief (in Swedish: religionsfrihet). This thesis focuses on the freedom of religion or belief in a European context, in particular on the European court of human rights and article 9 in the European convention for human rights. Some criticism has been directed against the Court to the effect that its practice and verdicts don't answer to the pronounced desire to develop a pluralistic and inclusive form of freedom of religion or belief.My aim is to examine, analyse and test three different theories, which all try to develop alternatives to the expression freedom of religion or belief, in relation to six verdicts from article 9 in Europe convention. My basic purpose is to try to find new ways of talking about freedom of religion or belief that might lead to a more inclusive, pluralistic and equal interpretation of that concept.The three theories wich I use are elaborated by Richard Amesbury (associate professor at Claremont school of Theology); Hugo Strandberg (TD at Åbo Akademi) and Eberhard Herrmann (professor in philosophy of religion at Uppsala University); and Martha Nussbaum (professor of law and ethics at the University of Chicago). The present paper is part of a project carried on by the Swedish Section of the International Commission of Jurists. Sweden has ratified several major international human rights instruments. Most of the rights are covered by national law, and only in exception is there a discrepancy between national and international law. Such a discrepancy is found in the UN Convention on the Elimination of all forms of Racial Discrimination, in which the State parties agree on penalizing and prohibiting the founding of and participation in racist organizations. Sweden is not complying with this statute, despite the fact that the government has ratified the convention.

This essay discusses in a comparative way the Swedish and Norwegian legal system, mainly laws that contain adoption regulations. It also compares the administrative work that the government in both countries practices in relation to the individual person. In this essay, focus lies on the legal rights of the child in the adoption process and how well the government and its service meet the requirements from abroad.This essay has shown that the government has many rules and regulations that regulate their work and that all the sub processes are designed to ensure the child?s best in the adoption in both Sweden and Norway. One of the social services primary missions is to protect children from suffering harm. Social service work should work based on the child?s best and have the child's perspective in mind. In all cases involving children, the focus is on the child's needs and interests and is regulated in Convention on the rights of the child (CRC). ABSTRACT Poverty, and in particular child poverty, is a serious social problem. Statistics show that the number of children living in poverty has increased over the last ten years. Earlier research shows that there are huge gaps in our knowledge of how the actors in civil society handle child poverty. With this study we hope to help fill this gap. The aim of our study is to look at how four different organisations working in the civil society in Uppsala perceive and handle child poverty.

Friheten från fattigdom - En rättighet eller något annat?

This paper investigates whether there is a right not to suffer from poverty. The investigation is being conducted from the theoretical standpoint/view that only civil and political rights constitute justiciable rights and rights proper from a moral stance, whereas economic and social rights constitute mere political agendas or less.In the search of an answer to this question the content of economic and social rights, and thereafter civil and political rights will be outlined, followed by an inquiry of what should really be considered as rights. Finally, the arguments against economic and social rights as real rights is presented and scrutinized.This paper will conclude that the stated difference between the above-mentioned sets of rights is illusory and that the right not to suffer from poverty ought to have the same status as civil and political rights..
