Med 90 år på nacken - en studie av internationella avtalsrättsliga alternativ till den svenska avtalslagen

Denna uppsats syftar till att redogöra för och analysera internationella alternativ till den svenska avtalslagen. I år (2005) var det 90 år sedan den svenska avtalslagen tillkom. Avtalslagen har under årens lopp kompletterats med rättspraxis och doktrin och har därmed utvecklats i takt med samhällsutvecklingen. 1989 ratificerade Sverige United Nations Convention on Contracts for the International Sale of Goods, härefter kallad CISG, med undantag för del ?? som utgör den avtalsrättsliga delen.

Värnpliktens vara eller icke vara : En argumentationsanalys av riksdagsdebatten om försvarsproposition 2008/09:140, angående Svenska försvarsmaktens framtida personalförsörjning

Sweden's government says in the bill 2008/09: 140 that military service should be suspended and replaced with a system based on voluntary recruitment. In the essay, I will make an argument analysis of the parliamentary debate on the bill from the 12th of June 2009 with the following questions: On what is the different side?s argument based on? Are the arguments essentially and factually substantiated? Is there a clear political party tendency among the for-/counter arguments? The method is a "Pro et contra" analysis, a logical systematization of the arguments. The analysis will take start in the headline; Conscription should be suspended in favour of a voluntary system based on contract employed soldiers. The presentation of arguments in the analysis will be guided by the chronological order.

Avbrott i elöverföringen : en analys av rättsförhållandet mellan elhandelsbolaget och konsumenten mot bakgrund av bestämmelserna avseende konsumentens avtalsbrott

SammanfattningElförsörjning är en av samhällets mest vitala funktioner och el förbrukas daligen av konsumenter. För att konsumentens ska kunna elförsörjas krävs det bland annat att denne ingår avtal om köp av el med elhandelsbolaget. Avtalet ålägger konsumenten en betalningsskyldighet för den förbrukade elen. Försummar konsumenten sin betalningsskyldighet kan elhandelsbolaget, i enlighet med 11 kapitlet ellagen och avtalet, vara berättigat att vidta avbrott i elöverföringen. För att rätten till avbrott i elöverföringen ska få vidtas krävs att vissa förutsättningar är uppfyllda.

Bibliotek på entreprenad : en studie gjord på Järna kommundelsbibliotek under vården 1996

This thesis is an attempt to study how a library that is driven by a contractor works. How allinvolved parts can cooperate. The main method used, is qualitative interviews. The authorshave made a survey at the public library in Järna in Södertälje county, where Boktjänst i JärnaAB has the business on contract since 1991.Following areas have been studied: organisation and assignment; librarysphere of activity andservices; the relations to the main library, and the vision for the future of the library.Some of the conclusions drawn by the authors are that when tenders are invited for a job, thelocal conditions must be taken into consideration. To have the same employer for the wholelibrary staff are likely to simplify the matters.

The purpose of this paper is to evaluate the work situation for temporary workers within the field of journalism. During the past decade, influential external forces such as commercialization, new technologies and increased competition have brought great changes within the industry. As a result, employers value flexibility of manpower, not least to reduce cost, where the flexible employee is usually leased by the media company from a manpower company. Today it is a normal practice with manpower companies and this way of hourly paid form of employment. Although the temporary worker can sometimes benefit from this kind of employment, there are also significant setbacks like job insecurity.

Intresset för soldatanställning lokalt : En studie på gymnasieungdomar boende i en garnisonsort

Hotet mot Sveriges säkerhet ser idag annorlunda ut än för 20 år sedan. Därför har Försvarsmakten infört ett nytt personalförsörjningssystem av soldater byggt på frivillighet. De närmsta åren behöver organisationen rekrytera 3 250 kontinuerligt tjänstgörande och 4 650 tidvis tjänstgörande gruppbefäl, soldater och sjömän. Syftet med uppsatsen var att undersöka hur gymnasieungdomar boende i en garnisonsort ställde sig till möjligheten att söka anställning som soldat i Försvarsmakten, både inom de lokala förbanden och inom övriga förband i Sverige. Studien skulle utvisa vilka gymnasieungdomar som kunde tänka sig en soldatanställning i hemorten vilket syftade till att ge en fingervisning för ungefär hur många man kunde tänkas rekrytera inom kommunen samt för att underlätta lokal rekrytering till soldatbefattningarna.

Viktigaste faktorerna för en anställning i Försvarsmakten : En undersökning av studerande och unga arbetandes attityder våren 2010

Den svenska Försvarsmakten står inför en stor omstrukturering, där de första anställda soldaterna är redo att ta anställning. I övriga Europa har liknande omstruktureringar från värnpliktsarméer till yrkesförsvar lett till problem med rekryteringen och svårigheter att behålla de anställda soldaterna. Det här arbetet genomför en undersökning på tre olika grupper (n=84), gymnasiestudenter, högskole och universitetsstudenter och unga arbetande, för att se vilka faktorer de anser är viktigast för att kunna tänka sig en anställning i Försvarsmakten. Gruppernas attityder till Försvarsmakten och hur de påverkar deras vilja till anställning har även undersökts. För att undersöka detta har en enkät använts.

Not enough attention has been paid to the correlation between the failure of peacekeeping operations and the actual source of civil wars. This text is an attempt to fill that gap. Hence the question: under which conditions is it possible for peacekeeping operations to replace the responsibility of the state concerning the security aspects of the social contract? The outset of the text, using the theories of Robert Nozick, is a theoretical approach towards the founding of states, described as the merging of entities. The theory serves a purpose since it, in combination with identity, illustrates in what manner the glue of society occurs and the rallying around other kind of loyalties like clans and ethnicities.

The purpose of this study is to explore the factors affecting an individual's working life mobility and how this mobility is perceived by the individual. The study has a qualitative approach and the theoretical part is based on Castells', Giddens' and Bauman's theories of modern society and employment in relation to the individual. The study concludes that external circumstances in combination with internal driving forces are the reasons behind changing careers. Vilka statsfinansiella effekter erhålls vid ökad produktion av förnybar energi?

BackgroundThis paper is based on an issue raised by the organization Energigas Sverige, which together with the Ministry of Finance has posed the question about the fiscal impact of an increase in biogas production. Since the fiscal effects of an increased biogas production are both positive and negative, due to reduced use of fossil fuels, we want to investigate this further.PurposeThe purpose is to describe and explain the obtained fiscal impacts of an increased biogas production and based on our problem: ?What are the obtained fiscal effects caused by an increase in biogas production?? we could see the following fiscal effects: positive impact on employment, increased revenues of social security contributions and income taxes, reduced unemployment costs and reduced tax revenues on fossil fuels. These effects are summarized in a negative tax revenue of 2,6 billion SEK. Along the summarized negative effect we also accepted one of the two prepared hypotheses, which stated that an increase in biogas production leads to a negative fiscal impact. Design/Methodology/ApproachWe have chosen to work from an Anglo-Saxon scientific tradition and furthermore, we have a positivistic approach when we want to explain the relationship between cause and effect of an increase in biogas production and the following fiscal impacts.

The demand of civil right for the employer that is rented out confronts the entire labour law regulation with new challenges.The purpose with this paper is an investigation of the principle of equal treatment in The Swedish temporary agency work act and also to create a deeper understanding of the effects of labour and employment relationship. An investigation of relevant collective agreements will be done to highlight the difficulties the principal of equal treatment is exposed to. Further on is there a will to gain understanding for the wage concept and what possible can be included in the wage concept in relation to the principal of equal treatment in The temporary agency work directive. By using the dogmatic method, an approach to descriptive identifying relevant sources of law and clarify the legal situation in the area.In the conclusions it will be determined that the principle of equal treatment in The Swedish temporary agency work act have different effects depending on if the temporary agency or if the client corporation is tied to an collective agreement alternative if a collective agreement is completely missing.

The changes in the Swedish meat- and meat processing industry have been substantial in recent years. These changes will alter the business environment for many companies. This thesis purpose is to determine an explanation of the efficiency in a labour-market related project. ?Enter? is an EU-financed project with a focus on long-term unemployed workers in the district Härlanda, Gothenburg. Starting in September 2004, Enter offers individually based coaching and job guidance to totally 110 young persons with problems entering the labour market. The goal is to provide these people courage to find either full or part time employment or to start study.

Downsizing : Hur överlevare av uppsägningar påverkas av upplevelsen

In today?s business environment, cost-cutting practices such as downsizing and layoffs remains a widespread phenomenon. Although, the understanding of the effects that these practices has on the remaining individuals, defined as the survivors, is poor. The focus in this paper is therefore to examine how survivors of layoffs can be affected on an individual level, and by what causes.The study was conducted using open-ended, qualitative interviews with three individuals with different experiences of layoffs. The empirical data was analyzed by extracting quotations from the interviews.The study found that layoffs affected the morale and attitude towards management of the individual, and that perceived justice and uncertainty are two causes of negative effects from layoffs..
