Idrottsjuridiken är ett underutvecklat rättsområde i Sverige och inom ämnesområdet finns mängder av frågor som behöver analyseras ytterligare. En sådan fråga är omfattningen av fotbollsspelarens arbetsrättsliga rättigheter och skyldigheter gentemot sin klubb. Fotbollsspelare utgör en speciell grupp på arbetsmarknaden som i många avseenden skiljer sig från normen av ?vanliga? anställda. Någon svensk rättspraxis för huruvida fotbollsspelare ska ses som arbetstagare finns ej.

In 1995 something happened that radically changed the European football. This was the arrival of the Bosman ruling, a decision made by the European Court of Justice which meant that players with an expired contract could change clubs for free and that the European Union's internal market including the free movement of labour was now a part of the European football. The effects of theBosman ruling are wildly discussed today. Many powerful people in the European football mean that football now is less competitive than before, that there are a small amount of teams that actually have the ability to win any trophies. This bachelor thesis is studying the effects of the competitive forces in football after the Bosman ruling as a case of the free movement in the European Union.

This thesis examines the interaction between European football and the European Union and if it can generate Europeanization. By using theories of Johan P Olsen and Claudo M Radaelli a theoretical framework was constructed in which Europeanization is seen as an interaction between the European level and the domestic level. The Europeanization is regarded as a two way process with elements of top-down and bottom-up pressures. The study focus on the changes and the actors in the Europeanization process and how the European Union as a top-level and European football as a bottom-level influence each other to European changes. The theoretical framework is used to analyze the Bosman case and the Cotonou agreement's implementation in a Swedish football context.

Den fria rörligheten för arbetstagare på EU:s arbetsmarkand är en fundamental rättighet och den gäller även för fotbollsspelare. RSTP:s regler om transferfönster, tränings- och utbildningsersättning, solidaritetsersättning, kontraktslängder och förtida uppsägning av anställningsavtal har i uppsatsen analyserats utifrån perspektivet om den fria rörligheten för arbetstagare. Regleringen med två registreringsperioder är begränsande för den svenska elitfotbollsspelaren men ändå homogena och därmed troligen förenliga med Art. 39 EGF. Argument för att stödja ett system med transferfönster är att sporten är säsongsbetonad och att klubbar har behov av att planera inför säsongen.
