En fallstudie inom Migrationsdomstolen i Stockholm

The aim of this study is to enhance the knowledge of target and performance management?s effects on the judiciary. In the past decades there have been a number of reforms in the general public sector of many countries. The management philosophy often used to describe these public sector reforms is called New Public Management (NPM). One main theme has been an increased focus on the management control systems, for example a greater emphasis on target and performance management. Many of these ideas have been criticized and the question regarding how far the focus on efficiency can be drawn without damaging the democratic rights has been discussed in different forums. Through a case study of Stockholm Migration Court, we have analyzed the functional and dysfunctional effects that arise when these New Public Management ideas are adapted to a public court. The common target of the Migration Court is ?the operation shall be run with high quality and efficiency?. The classical quotation ?what gets measured, gets done? is often used in cases like this and the challenge is to find a balance between the two concerns, namely to strive for an efficient organization without disregarding the legal security. The results from the study show that the Migration Court has well formulated targets which reflect the main mission of the court in society. However, the study suggests that there are a number of issues that the Migration Court has to consider to establish a well functioning target and performance management structure. Some of these issues are applicable to all judiciary while some concern internal management problems within the Stockholm Migration Court.
