"Trained to Empire, trained to rule the waves" : En jämförande analys mellan John le Carrés Tinker Tailor Soldier Spy och Tomas Alfredsons filmadaption
With the collapse of the Soviet Union and the 9/11 attacks, the landscape of the freedom of religion has changed. The issues now facing freedom of religion varies greatly from the issues that the drafters of the universal declaration of human rights faced after World War II.In the light of the new issues that States face in the intersection of religion and societal interest, scholars have criticized the European Court of Human Rights to give too much leeway to the States in determining how the human rights should be implemented, by using the doctrine of margin of appreciation. Critics of the margin of appreciation claim that it is based on culture relativism and that the doctrine undermines the universality of the human rights. In order to decide if the margin of appreciation has indeed led to a relativization of the human rights I compared it to the jurisprudence of the UN Human Rights Committee and its use of the Syracusa principles. My conclusion is that the jurisprudence of the European Court of Human Rights cannot be considered to be based on culture relativism.
Tillämpningen av positiv särbehandling : På grund av kön och etnicitet
Directive 2006/54/EG from the European Union concerns the equal rights between men and woman and the principle of equal rights. The purpose of the directive is that the Member states provide the equal rights between men and woman. Affirmative action is one exception from the principle of equal rights which is settled in directive 2006/54/EG, article 3. The purpose for the affirmative action must be to encourage the equal rights between men and women.EU has specific criteria to use affirmative action, which is created by praxis of the Court of Justice of the European Union. These criteria are that the affirmative action must involve an objective assessment, there must be equal qualifications between the person which is affirmative action and the person who is not, the positive action cannot be automatically decisive and this special treatment should be proportionate to the purpose.

Is Home State Taxation a step forward for SMEs? An SME?s ability for growth and integration in the EU after the HST tax reform
Small and Medium sized Enterprises (SMEs) within the European Union are currently facing many challenges one being access to financing due to high risk and probability of default, another being cross-border taxation issues with double taxation and information asymmetry. Since the aim within the EU is to be the most competitive and dynamic knowledge-based economy in the world with sustainable economic growth and social cohesion it is essential that the EU operates as a single market. Despite this need, harmonization continues to be far from achieved in the area of direct taxation which also affects the integration and growth opportunities for SMEs. In the Agenda for Entrepreneurship, the Home State Taxation regime, which is based on formula apportionment, has been proposed by the Commission as one option in order to mutually recognize the different Member States? taxation systems to facilitate cross-border activities and reduce ?red-tape?.

Den sociala sidan av kammarmusik
Playing chamber music is not only about music - there are social and practical things to deal with too. For example things like how to decide practising times and how to share the responsibility of the practical things like finding score for the music and booking rooms for the rehearsals. And also how to choose a way to interpret a piece when Members of the ensemble are having several different opinions about it, what kind of roles people in the ensemble take and how these roles work with each other. This is an essay about what I have learned about these things on the different lessons and lectures, from all conversations with my fellow students and teachers and from my own experience as a Member of different ensembles during my studies in the University of Gothenburg..
Röjningsbenägenheten bland privata skogsägare : en enkätundersökning bland medlemmar i SÖDRA
The intensity of cleaning declined dramatically in the early 1990?s in the Swedish forests.
Recession, an economic depressed forestry and the new law of silviculture from 1993, where
the duty of cleaning was removed have been considered as sources to the decline. This has led to a situation where huge areas of forests are untouched, which can lead to negative effects for those stands in the future.
The purpose of this thesis was to find out how the individual landowner acts and feel when it concerns cleaning activities. Has the landowner noticed Södra?s campaigns about cleaning and what sort of measure should Södra implement to increase the Members? cleaning activity?
The thesis is based on a opinion poll made through a random draw among all Södra?s Members.
Avtalslicensens förhållande till konkurrensrätten : När strider utövandet av en avtalslicens mot konkurrenslagstiftningen?
AbstractCopyright is designed to not interfere with society's general and overriding interest of effective competition. An effective market competition benefits consumers by lowering prices, raising the quality and expands the range of goods and services. The purpose of the paper is to investigate if the collecting societies licensing violates competition laws. On the basis of the investigation regarding the bill for a new Swedish copyright law (URL), mainly the new wording that regulates the license agreement, corresponds to the EU competition rules and customs within the area. The collecting societies licensing violates the competition laws in the following cases? Discrimination of Members because of nationality? Authors transferring their sole rights to global exploitation? The collecting society have the right to manage the rights after the author have left as a Member? Users that are established abroad do not get access to the repertoire of the collecting societies, the same goes for concerted practice if this is the purpose or result? Parallel behaviours that cannot be explained objectively? Dividing the market? Fixed Prices? Refusal to sign multi-territorial licenses? Apply different conditions for equivalent transactions resulting in competition disadvantages for a company that cannot be justified by reasonable causesCurrently there are no indications that the new bill to a new URL violates EU law. The author of the paper thinks this may change if the collective management extends, so that other Member states get the extended license agreements, then the single market is affected by the competition restriction that the new bill to the URL mean.
Statens kontroll eller individens frihet : En ideologianalys av statens och individens roll rörande Sveriges och Portugals narkotikalagstiftningar
The European Union has created a common plan regarding narcotics use and abuse within the European Member states. The aim here is to reduce the supply and demand for drugs among the citizens of the Union. However, the opinions on how to achieve these goals greatly differ among Member states. The range of attitudes varies from the strictly restrictive attitudes of countries such as Sweden, to the complete decriminalization of personal possession of all narcotic substances in Portugal. The purpose of this paper is therefore to study the underlying attitudes and approaches that these two countries have, and hopefully to give some light to how come there is this big difference in legal frameworks regarding a rather delicate political question.
The impact of the EU Timber Regulation on the Bosnia and Herzegovinian export of processed wood
Illegal logging and its related trade is of great concern around the world. The European Union Timber Regulation (EUTR) is a regulatory approach by the EU to prevent illegal timber and timber products to be placed on the European Union inner market. This means the regulation affects both actors in the Member countries as well as the actors exporting timber and timber products to the EU from non EU Member countries. This study aims to study the implementation process of the EUTR in Bosnia and Herzegovina (B-H), and its preconditions. Institutional theory is used to understand and explain how the EUTR affects B-H organisations? business environment, and how the organisations choose to respond to the EUTR.
Förutsättningar och hinder för att minska elektronikavfall : En studie över hur WEEE-direktivet påverkar Sveriges förebyggande åtgärder mot elektronikavfall
To meet the growing amount of waste from electronic and electrical equipment (WEEE) EU developed, year 2002, a directive (2002/96/EG) with the objective to govern the management and reduce the amount of WEEE. The directive is based on producer responsibility which makes the producer responsible for collection and dispose of WEEE. In 2012 a new revised directive (2012/19/EU), with tougher collection targets, was developed. Both the old and the new directive states that the approach to tackle WEEE should be prioritized in order of prevention, reuse and then recycling. Hitherto the amounts of WEEE has increased every year, making it relevant to examine which type of preventive measures the directive contains and how effective they are.
