Normally when purchasing a trip, an airline, a travel agency and a traveler is included in the purchasing process. Mostly a travel agency acts as an intermediary between the airline and the traveler. The travel agency is not considered to have any major part to the contractual relationship, usually the purchase agreement is considered to be covered by the airline and the traveler as the main parties. This is essentially the view shown from a legal perspective on the specific area. The application of legal provisions on the travel agency?s legal status may nevertheless bring a certain amount of ambiguity in the interpretation.

En återkommande debatt i pressen är huruvida gatukonst/spontankonst, såsom graffiti, är en konstform som bidrar till stadsrummet eller är klotter och ska behandlas som ett olaga tillbud på stadsrummet. Debatten behandlar ofta graffiti och sträcker sig alltifrån tillåtande av lagliga väggar för graffitikonstnärer till en uppfattning att graffitiutövare är grovt kriminella och att en nolltolerans ska hållas gentemot graffiti. De olika partipolitiska organisationerna förhåller sig olika till frågan, och det gör också debattörerna på våra stora svenska dagstidningar; åsikterna går isär. Jag finner denna schism intressant och vill i detta arbete djupare undersöka de olika åsikterna och bakgrunden till dessa. Genom att titta på olika infallsvinklar från olika ämnesområden såsom arkitektur, sociologi, kulturgeografi, dagspress med flera vill jag få fram en mer sammansatt bild än den som ibland upplevs i mediedebatten.

This thesis focuses on employers? use of non-­?solicitation of employees in commercial contracts within the union?s internal market and how this can result in restrictive practices in violation of European law. Using legal method, legal economic considerations, and guidance from modern American legal development in antitrust law, this thesis is aiming to investigate how this kind of anticompetitive cooperation in the European labor market should be assessed. The result seems to be that despite a distinct and pronounced restrictive approach to the application of EU competition rules in the labor market, there are strong incentives and not any legal impediment to apply Article 101 TFEU on no cold call agreements between employers. .

According to the Swedish Bankruptcy Act (SFS 1987:672) legal transactions can be reopened in cases of bankruptcy, if the transactions have been the cause of or were performed while the debtor was no longer solvent and thus harming the creditors. The legislations of the Bankruptcy Act chapter 4 §5 aim to protect creditors so that the debtor cannot withdraw their property in case of a forthcoming bankruptcy, as well as prevent creditors from taking measures against the debtor when the debtor is in financial difficulties. However, according to the Swedish jurisprudence there is a hierarchy as of according to which legal rules a legal transactions shall be enquired in case of bankruptcy. Firstly, a legal act must be valid, the transaction must thus be valid accordingly to either the law of contract, the law of property or according to the rules of corporate law. Each of these three legal areas have their own rules of annulment and any legal act has to be valid in accordance to any of the rules above before an action of reopening the transaction according to the Bankruptcy Act may be brought before a court.

This thesis looks at the difference between the legal protection in law and the legal protection in reality when a small company working with international trade comes in contact with seller's breach of contract. The thesis uses a case taken from a company with over 30 years experience trading with China and looks at the legal protection available along with the different possibilities of dispute resolution available to a company and then looks at the reasons why this legal protection never becomes a reality and the thesis also analyses some possible reasons for this gap between law in the books and law in reality..

The European union started as an area of economic cooperation, but has developed into an area of cooperation in many legal fields. There are these days even cooperation when it comes to dealing with criminals. There is a new procedure called the European arrest warrant which goal is to make the extradition of criminals between the different member states in the European union more efficient. Sometimes when a state receives a European arrest warrant they have to extradite the person in question without doing any investigation of their own. The procedure is based on the principle of mutual recognition.

The main purpose of this study was to examine how social workers interpret and legally practice the 6 § LVU (Care of Young Person´s Act) in regards to legal cer-tainty. The papers intention was to investigate and describe the legal scopes limits and deficiencies, linked to practical social work. The study was composed on a legal dogmatic method which implies to examine the law and its elaboration. The investi-gation was based on different court rulings of care of youths according mostly to 6 § LVU. Perusal and interpretation of the rulings have been necessary in order to clarify the issues.

In 2007 the Swedish government appointed a commission of inquiry with the task to submit a proposal of reduction in the requirement of a minimum legal capital for private limited liability companies. The commission of inquiry?s main proposal involved a reduction to SEK 50,000 compared to the prevailing SEK 100,000. Following a complementary proposal from the Justice Department suggesting a reduction to SEK 1, this paper aims at providing an understanding of the function and purpose of a minimum legal capital and the consequences that follows from an abolition of the statutory capital requirement. The thesis concludes that the legal capital?s main purpose is that of a standard contract internalizing the shareholder?s risk in business.

Construction companies are frequently criticized for high prices and long construction time. At the same time, statistics shows that construction workers are on the sick-list for occupational injuries or casualties more than other groups at the labour market.Skanska built a block of flats with tenant-ownerships in Gävle. The construction consists of concrete walls with in-fill walls in the front. The purpose with this degree project is to perform a risk analysis in work environment with focus on repetitive strain injuries and control the time report for in-fill walls manufactured in a field factory. The result of this project will help to make more realistic cost predictions in the future.This degree project has been performed in cooperation with the construction company Skanska.

A common way to stabilize high rise buildings is to use an elevator core built of concrete. Today, we use to build these elevator cores of in-situ concrete. Precast concrete twin wall (double wall) is a semi-finished product that has become more common in recent years. This diploma work studies how the twin wall works out as structural elements in an elevator core. The work also shows some possible ways of designing twin walls and highlights some important parts of the design that will be vital to the stability of the building.    The result shows that it is important to think through where the element joints should be placed.

The question of whether there is soft law in international law has been as much the subject of contemporary debate as whether or not there is private legal authority in the international society. The legal boundaries seem to be blurred by the process of globalisation and the recent shift in international law. The traditional definition of international law has been outdated as new forms of treaties has introduced new subject of law to the judicial arena. At the same time a supplementary map of law has been added to the cartography of international law, soft law. These correlating processes have comprehensive political and legal consequences at both the international and national levels.

Undersökningen vill visa på den motivation som dagens graffitimålare i Stockholm har till att göra sina målningar och vad jag som blivande lärare kan ta till mig vad det gäller att motivera elever till sina estetiska produktioner.Min frågeställning är: Vilka motivationer för estetisk produktion finns hos individerna inom graffitikulturen?Vidare ger jag en kort introduktion till graffitins tidiga år både i USA och sverige.Sedan presenterar jag ett referat från Håkan Jenners texter om motivation och motivationsarbete.Min empiri består av intervjuer med fyra stycken graffitimålare som är aktiva idag(2009). Intervjuerna har varit semistrukturerade och samtalen har utgått ifrån olika teman som skall hjälpa mig att förstå informanternas förhållande till graffitin. Dessa teman har bland annat inriktats på informanternas syn på sitt eget konstnärskap, grupptillhörigheter och framtidstro men framförallt drivet hos dem, själva motivationen.Jag har sedan tolkat deras svar med hjälp av de motivationsteorier som Jenner presenterat i texten Motivation och Motivationsarbete.I min slutdiskussion tar jag upp vad jag har lärt mig och kommer ta med mig i mitt blivande yrke som lärare.Den gestaltande delen i examensarbetet utgörs av citaten från examensarbetet vilka jag med hjälp av en dator och digitalprojektor projicerat stort på väggen och sedan målat av. Detta för att ge min gestaltning egenskaperna hos graffiti men på ett institutionaliserat sätt då jag har använt mig av typsnittet Times new roman vilket för mig konnoterar vetenskap och byråkrati. In conjunction with today?s increasing competition within the construction sector, more pressure is being placed on building contractors. Efficiency and improvements are necessary but without impairment to an ergonomic and safe construction site. This in is in order to reduce the construction costs and time but to retain the ability to deliver a high-quality contract.Various methods and prefabrication degrees are used, depending on the project's requirements and conditions. This analysis sets out to investigate and exhibit what qualifications are important when choosing a construction method for curtain walls.Advantages and disadvantages with each method have been analyzed and recommendations have been given to show when different methods are best suited.
