Barns rätt och äktenskapsåldern : En kritisk studie av svensk rätt i samband med de grundläggande principerna i barnkonventionen

The Swedish rules for marrying in Sweden are different for swedish citizens and foreigners. A swedish citizen has to have permission from"Länsstyrelsen"to marry before the age of 18 but a foreigner may marry without permission at an age of 15, unless a higher age is required by the foreign law. The main question in this essay is if the swedish international law concerning the age of marriage is compatible with the Convention on the Rights of the Child and/or the Swedish Constitution. The comparison is based on mainly two questions: Primarily the Swedish international law is discussed concerning which marrying age is good for the child. Thereafter it is discussed whether it is discriminating to have different marrying ages for swedish and foreign citizens.

Förbud mot dubbelregistrering av fartyg

In a recently published official Report from the Swedish Government (SOU 2010:73) a leg- islative proposal has been introduced. Its main purpose is to prevent parallel registrations of ships that are bareboat chartered to other countries. The legislative proposal claims that by preventing parallel registration of ships the Swedish Maritime Code will better corre- spond with the UN convention on the law of the sea.The UN convention on the law of the sea clearly states that ships are forbidden to fly two flags. There is however no restriction concerning parallel registration, simultaneously, in two registers. A ship that is bareboat chartered out from Sweden does not fulfil criteria re- quired in order to be deregistered, according to the Swedish maritime code.

In 1972 the regulations on tax surcharge were introduced. In the new system the sur-charge are imposed by the Tax Authority (skatteverket) and not the Court. Since 1995 the European Convention on Human Rights constitute law in Sweden, which means that Sweden is forced to guarantee its citizens the human rights in the Convention. Article 6 in the Convention states that everyone, in the determination of his civil rights and obligations or of any criminal charge against him, is entitled to a fair hea-ring within reasonable time. The Article also expresses the right for anyone charged with a criminal offence to be presumed innocent until proved guilty according to law (the presumtion of innocence).

The purpose of this thesis is to examine whether the concept of permanent establishment, as defined in Article 5 of the OECD Model Tax Convention on Income and Capital, is applicable to electronic commerce and if so whether the current definition is able to appropriately deal with the challenges of electronic commerce.In 2003, the OECD added a new section to the Commentary on the Model Tax Convention on Article 5. The new section is a clarification on the application of the permanent establishment definition in electronic commerce.The current definition of permanent establishment in the Model Tax Convention relies on the physical presence of a foreign corporation as the threshold for source taxation. Author: Gabriella Agné and Helena LarssonTitle: Disability policy program ? a case study of a municipals implementation of UNs Convention on the Rights of Persons with Disabilities.Supervisor: Marianne Westring-NordhAssessor: Ulf DruggeThis study aims to examine how a small municipal in southern Sweden works with the implementation of the UN Convention on the Rights of Persons with Disabilities and examine the assistant officers knowledge about this work and user organizations inclusion and user involvement.The study operates from a qualitative approach based on the results of nine semi-structured interviews with local politicians, assistance officers and representatives from three different user organizations.The results show that the municipal has chosen to work with the implementation of the convention by creating policy programs for their departments through dialogue with user organizations, and by mapping the accessibility to public places. The results also show that the assistant officers have been given no information regarding the convention or the policy programs from their employers and instead operate from national legislations and prepositions. The user organizations feel that they were initially included in the process, but that their impact has later been removed due to structural reorganization..

Omedelbart omhändertagande : En studie om interimistiska beslut inom LVU med hänsyn till barnets bästa

This study analyzes the court of appeals work on judging immediate care (6 § LVU) by the child´s best from 10 court cases. This study has been reviewing 10 court cases and reviewing the court of appeals applicable laws in their decisions on interlocutory order within LVU. The material than have been analyzed consists of immediate care of children, and the concept of the best interests derived from the UN Convention on the Rights of the Child.The legal sanctions includes when a state signs a convention, which Sweden has. This means that Sweden is at their disposal to offer all children within its territorial limits, up to 18 years may take part of the rights set down in the Convention of the Rights of the Child. This means that all decisions relating to the individual child, should always be taken with respect to the best interest of the child, when a child for varoius reasons end up in a lawsiut.The concept of the best interest of the child are vague and abstract because it is not clearly defined.

Our aim and purpose with this essay is to problemize this broad definition. Our hypothesis is that the definition brought by the UN Convention on the Rights of the Child is too wide and therefore brings difficulties when children of different ages beneath eighteen should and shall be treated the same.

Asylsökande barn i kläm mellan myndigheter. : Om omhändertagna asylsökande barns skydd och rättigheter i Sverige.

The purpose of this thesis is to find out how the Swedish authorities comply with international law by studying the protection of asylum-seeking children that are apprehended by Swedish authorities according to the legislation of LVU because of abuse or neglect and thereafter are deported together with their parents. The aim of this thesis is to find out if Swedish legislation and praxis is consistent with international law through the Convention on the Rights of the Child and EKMR. Would it be possible to increase the protection of these children through incorporating the Convention on the Rights of the Child in Swedish law, through a wider interpretation of the principle of non-refoulement or through more morality in the law? The thesis has been conducted as a literature study where the right-dogmatic method has been used to compare Swedish and international law. The theories by Dworkin about morality and law have been compared to Peczeniks right-dogmatic theories.The review shows that Swedish authorities are infringing article 2, 3, 12 and 19 of the Convention on the Rights of the Child, when it comes to the protection of asylum-seeking children. The best way to increase the protection is to incorporate the Convention on the Rights of the Child in Swedish law.

Historieskrivning och nationellt minne i Turkiet: en studie i hur historia kan glömmas och omöjliggöra ett folks upprättelse

The aim of this study is to examine Turkish nationalism in order to find what factors that play a part in Turkey's inability to confess and discuss such events as the Armenian Genocide, which took place between the years of 1915.-1923, by the fall of the Ottoman Empire. The factors found and examined closely are collective memory and the use of history. The paper is a case study of Turkey with a theoretical approach, trying to apply theories of nationalism, collective memory and history-writing on Turkish nationalism, in order to find an answer to how these factors stands in the way of reconciliation.Conclusions are that Turkey as a nation is stuck in a romanticization and glorification of the time of their founding leader, Atatürk, and the thought of the pure, homogenous Turkishness. This makes the nation incapable of discussing and accepting what others in this case acknowledges as historical facts. The taboo-making of these matters makes reconciliation today not possible..

Kvinnokonventionen- självklar men frånvarande. : En kvalitativ studie om implementering av Kvinnokonventionen

The purpose of this study is to examine the implementation of the Convention on the elimination of all forms of discrimination against women, CEDAW, in Uppsala local council and county council. The aim is to examine how the respondents, in their daily work, understand and implement the convention as well as how they consider the prerequisites for a successful implementation. The study was conducted using qualitative interviews with three civil servants and four politicians. The theoretical approach was implementation theory whose concepts willingness, comprehension and capability were used as tools for the analysis. The results portray CEDAW as a well-known treaty amongst the respondents but at the same time absent in local politics and everyday work.
