Yttrandefrihetens gränser : En prövning utifrån tre fall och tre teoretiker

Freedom of speech has been a well discussed subject. Great philosophers and theoretics like Plato, Voltaire, Locke and Mill have again and again showed the importance of Freedom of speech. Since the world have become bystanders to a series of events that can only classify as crimes aganst Freedom of speech, it has become more important to study the phenomenon and analyse it. By finding cases where the Freedom of speech has been compromised and analyse them in frames of three different theories, the argument of truth, the argument of democracy and the argument of tolerance, this paper makes the boundaries of Freedom of speech a little clearer, and also makes a discussion about how reasonable the boundaries are possible. Everything according to the three theories.

Att vara eller inte vara Charlie : En retorisk analys av opinionsmaterial fra?n svenska webbtidningar efter attentatet mot Charlie Hebdos redaktion

This study aims to examine the argumentation regarding Freedom of speech and the statement ?je suis Charlie? (?I am Charlie?) in eight opinion articles from different Swedish web magazines. Two doctotral dissertations who?s main topics are the Freedom of speech and different types of arguments regarding freedom of speach, was used in this study. The study also uses the actual Swedish law surrounding the Freedom of speech, as well as the freedom of the press and breaches of these laws.

Om yttrandefrihet : Gymnasieelevers tankar om rättigheter, ansvar och begränsningar kring yttrandefriheten

This essay focuses on different aspects of the concept of Freedom of speech. The purpose is to examine the opinions and thoughts that upper secondary school students have on rights, responsibilities and limitations when it comes to Freedom of speech, and to investigate theirschool experiences of the mentioned freedom. Focus groups have been used as method and two group interviews have been conducted, one at a vocational and the other at an academic upper secondary school. Overall, nine students from the third grade participated in the interviews.The essay's results show that the students believe that everyone in society should have theright to be heard, whether you have extreme or divergent opinions. The interviewed studentsexpresses that all people have great responsibility for their opinions, however that, opinionsdiffer on how to interpret the concept of responsibility.

Abstract: The purpose with this study is to analyse the political debate about Freedom of speech in Sweden and Denmark, after the caricatures of the Islamic Prophet Mohammed that the Danish newspaper Jyllandsposten published in September 2005. For this debate four political parties have been chosen. These are: Socialdemokratiska Partiet and Moderata Samlingspartiet in Sweden and Socialdemokraterne and Venstre in Denmark.An idea analysis has been chosen as method, and dimensions as an analysing tool. The overall result of the analysis is that right- and left political parties in Sweden and Denmark are more alike, than different in their political debate about free speech. They all wish for total Freedom of speech, and see that as the foundation of the democratic society.

AbstractSweden has had a long tradition of freedom of the press and Freedom of speech. Today the judicial area is regulated by the constitution of the press and the constitution of speech. The purpose of the two constitutions is to secure the right for every Swedish citizen to express their thoughts, opinions and feelings.The constitutions are designed to regulate the techniques with which the information is distributed and not to regulate the information in itself. This fact has caused a debate to arise on the subject whether the constitutions are still suitable to regulate the judicial area when the technical development causes the constitutions to get out of date and in need of constant updating. As a rule the usage of social media is not regulated by the constitution of speech the information distributed through these webpages can be included by the protection given by the constitution but very few of these webpages fulfill the criteria?s demanded by the constitution.The purpose of this essay is to ask the question whether the constitution of speech should be reformed to better regulate the technical development in the future.

This essay intends to investigate the view on Freedom of speech in Sweden. The expanding of the hate crime law rises the question if there is a current changing view on Freedom of speech. By comparing motions concerning an expanding of the hate crime law from different periods, I am able to conclude if and how the view on the term Freedom of speech has taken place. This is done in a descriptive analysis of terms, where the different values and arguments for a change is compared. The material is taken from the period 1991-1993 and 2000-2001.

The purpose of this thesis is to investigate the employees´ duty of loyalty to their employer when making statements on social media networks and if this opposes the employees´ right to Freedom of speech. Another purpose of this thesis is to investigate Freedom of speech from an EU juridical point of view. Also a discussion concerning gender issues on this subject takes place is presented in the thesis. The questions to answer the purpose of this thesis are the following: Where is the line drawn for what an employee can publish on a social media network without breaching their duty of loyalty towards their employer?, and How does an employee´s Freedom of speech relate to these types of statements on a social media network? The method used for this thesis is the classical legal method.The legal inquiry shows that duty of loyalty is a hidden clause in all employment contracts, and it must be respected by the employee.

Yttrandefrihetens dilemma : en idécentrerad studie om yttrandefrihetens roll och begränsningar

This paper concerns the Freedom of speech in our democracy and the principles underlying the restrictions. The study is aimed at using a descriptive theory to provide a useful basis for analyzing a justification of the role behind Freedom of speech and its limitations. The analysis is made on the basis of the Swedish parliament debate in the form of motions and the non-governmental organization Swedish Helsinki Committee's report. The study has a focus on the law of hate speech and will be done with an idea centred analysis. On the basis of democratic theory, the central role of Freedom of speech was clarified on the basis of a clear need for a reliable communication.

The purpose of this study is to investigate the attitude of teachers regarding including democratic behaviour when grading students in social science. The purpose is also to investigate whether the teachers consider there to be a conflict between the right of Freedom of speech and the democratic values that the school is supposed to make sure the students have when they graduate. The study also investigates the problems political decisions encounters when going from theory to reality.The theory of Ulf Petäjä on why the Freedom of speechs is important, Robert Dahls theory about the democratic process and Anders Sannerstedts theory about converting political decisions to reality is what this study is based on.The study was carried out at three different schools; Teleborg Centrum, Växjö, Dackeskolan, Tingsryd and Centralskolan, Virserum ranging from the spring of 2006 and the spring of 2007. The method used except from litterature studies was interviews with active teachers.This study shows that teachers don?t think it?s acceptable to grade students based on their political ideology.

Pox-rättegången, Mangafallet och Tintin-gate : en diskursanalys av debatter och nyhetsrapportering i svensk media om tecknade serier och censur

The study aims to examine how censorship and comics have been discussed in three debates. The aim is also to identify discourses and the orders and relations of power constructed in the debates, and to examine how librarians should handle debates about censorship and comics. Selected sources are articles from Swedish newspapers and tabloids about the debates on the Pox-trial, the manga case and the debate about Tintin in Kulturhuset. The results from the analysis indicates that the debates have been dominated by two main discourses: a discourse on Freedom of speech and a discourse on social responsibility. Within the discourse of Freedom of speech there is a range of perspectives that emphasize: artistic freedom, the need for open and free conversations, a discussion about how the comics are assessed in comparison with other media formats as well as a discussion about moral and moralism.

This paper is a case study on Bradley E. Manning, famous for leaking classified intelligence to media, or in the charge sheet?s words: ?knowingly give intelligence to the enemy, through indirect means.? My opinion is that this sort of dilemma is a question of values, how you view the world and, most important of all, human rights and the philosophy of rights. Therefore I decided to sort out the arguments regarding the issue of Freedom of speech versus the state?s need for protection.
