I föreliggande studie undersöks hur rättssäkerheten tillämpas och tolkas allmänt för barn som placeras utanför det egna hemmet av socialtjänsten samt hur rättssäkerheten tolkas och tillämpas när det rör barn som är placerade på ideella kvinnojourer. Studien är av rättssociologisk art. Metoden som används i studien är en kombination av rättsdogmatisk metod och samhällsvetenskaplig metod. Detta för att genom den rättsdogmatiska metoden studera lagstiftning och den samhällsvetenskapliga undersöka hur lagen tillämpas i praktiken. Materialet består av texter samt intervju.

The purpose of this paper is to investigate on what basis a child is committed into care according to the law and to see on which grounds the decision about committed child care in law practice are taken when a child is committed to care due to parents who are mentally retarded. To better understand the juridical grounds for these decisions I will also in a short background describe the meaning of the term mentally retarded, how mental retardation and parenthood has changed over time and how different opinions are expressed in the law. Both people with mental retardation and children have in recent years gained their rights and sometimes these rights end up in conflict with one another. In those cases, what is in the best interest of the child, should be decisive. The children who have mentally retarded parents are at risk to not have their physical, psychological, emotional, social and intellectual needs met and are therefore being unfavourable developed.

The Human Rights claim that all humans have special rights that are not allowed to be broken or violated. Although these rights are broken and violated by states every day. One major fact that makes this possible is the principle of sovereignty that includes all states, and which says that every state has the power and right to make decisions and create laws within the own country without the interference of other actors. In other words, the problem is that the states have to much power in relation to actors usch as the United Nations and to the rules of the Human Rights. This study is a research on how dystopian features are expressed within different genres. The purpose is to discuss films that contain dystopian features in relation to genre and to examine if there are shared conventions in the films that can make dystopia a film genre on its own. The theoretical base includes genre theory and Rick Altman?s semantic/syntactic approach to film genre. Five films from different genres, all produced within the time period of 2000-2010, are analyzed with a semantic/syntactic approach to genre and then discussed in relation to dystopia and prior research.

According to the Conventions on the Rights of the Child, children have the right to make their voices heard and express their opinion in situations concerning them. With this paper the authors have chosen to explore social worker?s view?s on children?s participation and influence, and how these are manifested through the entire case process. The focus in this study has also been the positive and negative effects the children?s influence may have.To investigate this, a qualitative study using semi-structured interviews has been conducted.

A qualitative study is presented concerning children?s participation in the local decisionmaking in Swedish municipalities. The study also aims at finding out what are considered to be successful factors and obstacles connected to the implementation of children?s participation in local decision-making. The study contains a summary of the convention on the rights of the child, focusing on article 12, as well as previous research findings concerning children?s participation and factors enabling respectively hindering participation.

Childhood as a social category is under strucural redefinition. In this thesis the child and childhood are understood as socially constructed phenomenons. Focus is laid upon the construction of the concept ?in the best interest of the child? wich in The UN Convention on the Rights of the Child is defined as beeing the foremost important view to take into account when decisions wich affect children are made. The following essay examines the conditions of whether a child perspective is recognised in the second authority of the new Swedish asylum process, the Migration Court of Law and inquire into the viewpoint of these decision makers as to what a child perspective in this context represents.The method used was a qualitative study that contained interviews with eight respondents, divided into four judges and four jurors. The material gained from the respondents was then analysed by using theories regarding a child perspective and theories that deal with interpretation of a text, ethics and court sociology.A few conditions of whether a child perspective is recognised has been revealed and we also found that the child perspective in theory is a wide perspective, that includes many aspects of how a child is recognised. In practice, however, the child perspective can be divided into two separate perspectives where one of them involves an adults view of a child?s perspective, and the other involves the perspective of a child, the child?s own view of its existence and perceived reality..

This paper?s purpose is to examine a Swedish missionary activity from a human rights perspective. As a scope I have chosen the Swedish evangelical mission to Congo-Brazzaville, from its establishment in 1909 to the congolese church's self-determination in 1961. I consider certain elements of the missionary activity that affect human rights, to discover wether the activity was in order with modern day human rights standards or not. During these years, Congo was part of the French colony Equatorial Africa, so the missionaries? part in the colonial discourse is taken into consideration.

This essay discusses children?s rights and control and system of rules in HVB-homes that provide treatment for adolescences with drug abuse prob­lems or criminal behavior. The results of this study are based on interviews with four persons working in managerial positions on different HVB-homes and shows the difficulties of having a children?s rights perspective in a con­text where a higher level of control is necessary to protect the best interest of the child. The study suggests that the question of balance between children?s right and the need for controlling system of rules needs to be fur­ther dis­cussed to improve, and as far as possible guarantee that these adoles­cence receive best possible care and do not suffer unfair restrictions on liber­ties..

Growing up as a child, we had a Dog. To us, it was like a means to an end. That is, hunting other animals for food and for protection, with no special care and treatment given to this animal. Butas days passed by I began to witness a wind of change against such actions. I was made to understand that we were committing two crimes-: using the Dog as a means to an end (for hunting and for eating animals).

In 2006 there was a change in LMA (1994:37) that clarified the division of responsibility be-tween the Migration Board and the municipalities, concerning unaccompanied children. The social services should now be utmost responsible for the housing and care of these children, to assure that they gain the same standards and rights as all other children. The aim of this essay has been to examine how the division of responsibility has influenced the work of the social services and how they interpret their responsibility for the unaccompanied children. How do the social services investigate and make decisions concerning these children? Do these chil-dren have the same rights as other children? To answer these questions a legal study was made, followed by qualitative research interviews with four social services that receive unac-companied children.

The purpose of this thesis is to shade light on some of the problems associated with rights issues with regard to Swedish law. Syftet med vår studie var att att se vilka diskurser som finns kring barnperspektivet bland socionomer verksamma inom barn- och ungdomsenheter. Genom att identifiera diskurser kring detta begrepp var även målet att kunna bidra med ny kunskap kring hur barnperspektivet kommer till utryck och tolkas av utredarna. Vi har använt oss av kvalitativa enkäter med öppna frågor. Enkäterna delades ut till socionomer verksamma inom barn- och ungdomsenheter i åtta kommuner i Sverige. Resultatet har sedan tagits fram med hjälp av diskursanalys.

A thematic of children portraits defines this period of Kandre?s writing, which consits of the following works: In a Different Country (1984), The Annunciation (1986), Bübin?s Kid (1987), The Burning Tree (1988) and Aliide, Aliide (1991).Linguistic components, such as the word ?child?, the name ?Kid? and a reconstruction of the concept of childhood, holds an actuate position in these narratives when they first appear in direct relation to the protagonists. This suggests how generally accepted categories and concepts consciously are at work in Kandre?s writings.
