VD-Avtalet - en studie av rättsläget
Chief executives and other persons in management positions are not applicable to the same protection system as other employees. Lagen om anställlningsskydd is not applicable for example. Instead all terms and conditions are in the employment contract, which get increased importance. The employment contract for a chief executive is comprehensive. This essay focuses on employment protection, wages and compensation, loyalty during the employment, secrecy and competitive clauses.
"Helt sjukt snyggt..." : Ungdomsspråket i romanrepliker, en jämförande studie
I denna uppsats studeras det ungdomliga talspråket i romanrepliker genom stiljämförelse av dessa i tre ungdomsromaner, utgivna resp. 1911, 1967 och 2008. Syftet är att undersöka vad som är typiskt för ungdomsspråk, se i vilken mån dessa typiska drag finns i de tre romanerna, och hur detta har ändrat sig under loppet av hundra år. Det studerade materialet består av 100 repliker ur var och en av de tre romanerna, och dessa har undersökts med avseende på antal ord per replik, satsstruktur, sägeverb, slang och svordomar, "onödiga" småord, stilmarkerande ord och typografiska markeringar av prosodin. Som jämförelsematerial har använts flera olika tidigare undersökningar av ungdomsspråk, i första hand Klingberg (1970), Labov (1972) och Kotsinas (1994).
En fjärils vingslag - Om påståendedoktrinen och skiljeförfaranden, särskilt i investeringstvister. En probleminventering efter NJA 2008 s 406
Det sägs att en fjärils vingslag i Brasilien kan utlösa en storm i Texas. I vår alltmer globaliserade samtid ligger det troligen mer sanning i det sagda än någonsin tidigare. Föremålet för föreliggande uppsatsen är en rättsgrundsats ? en av Högsta domstolen etablerad rättsprincip ? betecknad påståendedoktrinen, närmare bestämt doktrinens betydelse i skiljetvister i allmänhet och i investeringstvister i synnerhet. Bakgrunden till de problemställningar varom uppsatsen handlar står att finna i Högsta domstolens avgörande NJA 2008 s 406, vari Högsta domstolen, med undanröjande av skiljenämndens dom, gjorde följande synnerligen intressanta uttalande: ?Det är en etablerad grundsats i svensk rätt att skiljemännen vid [behörighetsprövningen] skall tillämpa påståendedoktrinen.

The legal right to take time off from work to care for one`s children has been regulated in Swedish law since late 1930. This right was limited to mothers and was provided under restricted forms. There was a long qualification period and the length of parental leave was limited.Since then, the right to parental leave has been extended through several modifications of the law. The question of equality in both the labour market and the private sector has been one of the greatest forces behind these changes. By including men in the right to take parental leave, the work place has become more equal and it is now considered a natural part of the employee?s life to request time off to care for children.Labour Arbitration Court has shown through its case law that equality in the work place is of the utmost importance and has shown its support in this matter through its judgements.

The applicability of the Swedish tax rules regarding transfer of ownership in closely held companies largely de-pends on the interpretation of the prerequisite, equal or similar activity, which can be found in section 57, clause 4 of the Swedish Income Tax Act.The ruling made by the Supreme Administrative Court in RÅ 2010 ref. 11 changed the concept of equal or similar activity. The ruling lead to that the shares in a closely held com-pany was qualified due to that the capital from the original company had been transferred to the operating company. According to the ruling the original company had been split into several companies, thus was the companies considered to carry out equal or similar activity.
Den rådande tolkningen av samma eller likartad verksamhet : Konsekvenser vid generationsskiften i fåmansföretag
On the 26th of January 2010, the Supreme Administrative Court in Sweden gave five rulings which greatly affect the possibility to keep a close company within a family by transferring the ownership of the company to the next generation. The five rulings concern the interpretation of the prerequisite, same or similar activity, which can be found in section 57, clause 4 of the Swedish Income Tax Act. The prerequisite is fulfilled when an entire or parts of a business is transferred to another close company and the receiving company?s business activity is within the framework of the transferring company?s business activity or when the companies have a similar connection. Depending on which shares that are being evaluated, the prerequisite can refer to both the shares in the receiving or the transferring company. When the prerequisite is fulfilled, a standardized amount of the business income will be taxed as capital gains and the surplus will be taxed as earned income.

Through the rulings RÅ 2010 ref. 11, HFD 2011 ref. 75 and HFD 2011 not 88 the Swedish Supreme Administrative Court have extended the concept of same or similar activities which can be found in section 57, clause 4 of the Swedish Income Tax Act. Through the ruling the Court has partly clarified the application area of the regulation but question marks still remains.In the statutory text there is no definition of what shall be regarded as same or similar activity and the preparatory work does not give any further direction on how the concept should be interpreted. Ever since the amendment in 1995 the general view has been that activities can be transferred between different companies without affecting the waiting period in the company of origin.

Policy documents in the public library field, such as the library legislation, local political goals and intra-library plan documents, often include ambitious but ambiguous formulations. This two years master?s thesis examines the relationship between four policy documents and library practice in a local context. The theoretical framework is inspired by a sociocultural theory developed by the Swedish professor of pedagogical psychology Roger Säljö. The theory emphasizes the importance of context to learning and development.The thesis? method is a case study.
Hur ser barns yttranden ut? : Yttrandetyper, bisatser och yttrandelängd hos svenska 3- och 4-åringar
Children?s utterances have been studied in different languages; however, only a few studies refer to Swedish. The aim of the present study is to describe utterance types, subordinate clauses and utterance length for a group of three and four year old Swedish children without known functional impairments.The study included 29 children, 17 girls and 12 boys, in a larger city in the south-east of Sweden. The children, all native Swedish speakers, were aged 3;0 to 4;11. Sound recordings were made during a playing session with one of the authors in the children?s day care centers.The utterances were divided into the categories elliptical responses, incomplete and partly unintelligible utterances, imitative utterances and independent utterances.
Lojalitetsplikt och yttrandefrihet i sociala medier
The purpose of this thesis is to investigate the employees´ duty of loyalty to their employer when making statements on social media networks and if this opposes the employees´ right to freedom of speech. Another purpose of this thesis is to investigate freedom of speech from an EU juridical point of view. Also a discussion concerning gender issues on this subject takes place is presented in the thesis. The questions to answer the purpose of this thesis are the following: Where is the line drawn for what an employee can publish on a social media network without breaching their duty of loyalty towards their employer?, and How does an employee´s freedom of speech relate to these types of statements on a social media network? The method used for this thesis is the classical legal method.The legal inquiry shows that duty of loyalty is a hidden clause in all employment contracts, and it must be respected by the employee.

Det är idag vanligt att företag löser sina tvister genom skiljeförfarande. De har här större möjlighet att kontrollera förfarandet och få ett snabbare avgörande än i en domstolsprocess. Förfarandet är dessutom konfidentiellt. Skiljeförfaranden sker ofta mellan parter från olika länder och det är vanligt att parter väljer forum i Sverige i internationella skiljeförfaranden.I vissa situationer kan en part befara att den framtida skiljedomen blir verkningslös på grund av att en motpart kommer att agera på ett sätt som tillfogar parten skada eller försvårar verkställigheten av domen. En part kan därför vara i behov av en säkerhetsåtgärd både före, under eller efter förfarandet.

Syfte
Syftet med detta arbete har varit att undersöka om och hur väl förtrogna betygssättande lärare, specialpedagoger, speciallärare och rektorer ute på kommunala skolor är med Undantagsbestämmelsen. Att undersöka om lärare känner till och tillämpar Undantagsbestämmelsen samt vad de har för attityder gentemot den är intressant eftersom vi i vårt framtida yrke som speciallärare kommer vara den elevgrupps, som bestämmelsen berör, röst och företrädare vid till exempel betygskonferenser.

Tidigare forskning kring betyg och bedömning visar att lärare, när de känner osäkerhet, inte bedömer enligt gällande betygspraxis (Klapp Lekholm, 2008; Selghed, 2011).

This trend has been consistent and in today?s world numerous commercial parties employ such contracts in their business transactions. The reasons for the extended use of standard form contracts are the benefits that can be obtained for the parties such as time efficiency, effectiveness and price advantages. Standardised contracts often regulate certain issues of the contract for example the way of delivery, remedies and complaints.
