Politiskt förtryck: orsaksförklaringar, mekanismer och uttryck : Rohingyafolket som Agambens homo sacer i kontrast till Kymlickas liberaldemokratiska perspektiv

The persecution of the Rohingya Muslim minority population in southwestern Burma has come to the fore in recent years. The aim of this study is to first analyse the degree and respects of biopolitical control in the case of political oppression. Secondly, the aim is to compare the similarities and differences when it comes to the causes, mechanisms and expressions of the two theoretical starting points in the case.Giorgio Agamben´s biopolitical theory, which tries to reconnect state control over life and death with modernity, forms the basis of the analysis. Will Kymlicka´s liberal theory on minority rights serves as a theoretical comparison tool. Methodological starting points to the specific bilateral purpose will be both of the textual and discursive analytical tradition.

Den suveräna tjänstemannen. Anomin i förvaltningshandlandet och tjänstemannens suveränskap.

Uppsatsen behandlar frågan om vilken relation som finns mellan de handlingar statliga tjänstemän utför i sitt arbete (förvaltningshandlande) och de underliggande normer som skall styra detta handlande. Tesen som författaren driver är att denna relation präglas av en anomisk brist. Baserat på en genomgång av relevanta juridiska begrepp återges konkreta exempel på handlande av statliga tjäntsemän. En teoretisk genomgång av relevant teori hos Hans Kelsen, Carl Schmitt och Giorgio Agamben ligger till grund för en analys av anomin som en ofrånkomlig ontologisk aspekt av allt normbundet handlande. The thesis treats the question of what relation there is between action performed by public officials and the norms that supposedly directs these actions.

Etiken och det heliga En studie av relationen mellan etiken och det heliga i Giorgio Agambens och Emmanuel Levinas filosofier

The first aim of this study is to discuss and try to understand the relationship between the holy andethics, and more specifically how it can be understood, which is the critical question that I haveformulated, in Giorgio Agamben?s and Emmanuel Levinas? philosophies. The second, moreconstructive aim is to discuss whether the holy can be understood as something good or problematicin relation to the society.Rooted in philosophy of religion and ethics, I have first tried to discuss how the holy has beenunderstood in the philosophy of phenomenology and in the texts of Rudolf Otto, Mircea Eliade andEspen Dahl. The holy has in the history been understood as something central in religions, and hasalso not been connected to the idea of ethics. Recently it has also been critized ? by Dahl ? for notbeing so pure as first thought of.In Levinas texts the holy has been understood as something differentiated through his distiction,in the Talmudic reading ?Desacralization and Disenchantment?, between the holy, which can beseen as something pure, and the sacred which can been seen as something impure and a form ofdegenerated holiness.

Våldet, Rätten och Rättvisan : En kommentar till Walter Benjamins Försök till en kritik av våldet

This paper is an attempt to re-read Walter Benjamin?s essay ?critique of violence? by separating what we here presume being its three-part core or axis, namely Right (rätt, as in Law), Justice (rättvisa) and Violence (våld), and then make an inquiry into the relationship between them, or, to what extent these three parts relate to each other. The method for doing so is at first a close-up reading of Benjamin?s text, where the core parts are being mentioned. Thereafter we will take a look at some of the most prominent attempts to read Benjamin to see to what extent their interpretation is compatible to ours.

Penumbra Suecica : Den negativa fo?reningsfriheten i Sverige mo?ter Margin of appreciation

This paper discusses if Margin of Appreciation is compatible with the idea of universal human rights. Through the case of Negative freedom of association in Sweden, it studies the phenomenon that Giorgio Agamben has called the State of exception.The questions that are discussed and answered are 1) How does the rights theories of Jack Donnelly and Ronald Dworkin relate to Margin of appreciation, and 2) How has Margin of appreciation been applied in cases concerning the negative freedom of association in Sweden, in the European court for human rights. These questions and answers are then used in the discussion on how Margin of appreciation affects the concept of universal human rights. .

"Homo sacer" i det svenska folkhemmet En fallstudie av rädslans politik och det konstanta undantaget från den konstitutionella ordningen i den svenska kontexten

This case study is an attempt to give empirical support to Georgio Agambens theory, regarding how the exceptions from the constitutional order should be regarded as a constant element in modern societies. The purpose was to investigate if Agambens theory is valid in the Swedish context. The exception, as definied by Agamben, is a reappearing phenomenon, which implies that the constitutional order is fragile. Individuals and groups are transferred into ?homo sacers?, meaning people that is to be regarded as legally naked, and offset from the rest of society.What then is it that make the legal norms fragile? In this thesis I will discuss the causality of moral panic.
